Governing Petitions to the Single Justice
Pursuant to G.L.c. 231, § 118
The Appeals Court has proposed a revision to its existing "Standing Order Governing Petitions to the Single Justice Pursuant to G. L. c. 231, § 118 (first paragraph)." The proposal will expand the scope of the existing standing order to include motions filed pursuant to Mass.R.A.P. 6 to stay judgments and to stay the execution of a sentence. The revisions will also require petitioners to file certain documents that are essential to the single justice's screening of the petitions and motions, and also to file a copy of the petition or motion in the trial court.
