Proposed Revisions to
Canon 3B(9) of the Code of Judicial Conduct
The Justices of the Supreme Judicial Court invite comments on a proposed revision of Canon 3B(9) of the Code of Judicial Conduct. The Justices previously published for comment revisions to this canon proposed by the Ad Hoc Advisory Committee to Study Canon 3B(9) of the Code of Judicial Conduct. The current proposed revisions were prepared after the Justices considered the Report of the Ad Hoc Committee and the comments submitted in response to the earlier publication.
The proposed revision to Canon 3B(9) and its commentary
can be found on this website. To add context to the proposed revision, a proposed Guidance Regarding the Issuance of Explanatory Memoranda
is also posted on this website. To render further clarity on appropriate public comment by judges on pending cases, the Justices intend to issue a Guidance setting forth their views regarding memoranda that provide or supplement explanations for a previous order.
