Invites Comments on a Proposed Amendment to
Rules 33, 41 & 77 of the Massachusetts Rules of Civil Procedure
The Supreme Judicial Court's Standing Advisory Committee on the Rules of Civil Procedure invites comments on a proposed amendments to Rules 33, 41 and 77 of the Massachusetts Rules of Civil Procedure. The amendments address rules that were overlooked when the amendments resulting from the one-trial legislation were implemented effective March 1, 2008.
The proposed amendment to Mass. R. Civ. P. 33 would remove a cross reference to a section that has been deleted; the proposed amendment to Mass. R. Civ. P. 41 (b)(3) would add dismissal under the new 12(b)(10) to the list of dismissals that do not operate as an adjudication on the merits; and the proposed amendment to Mass. R. Civ. P. 77(d) would delete a reference to the district court's ruling on requests for rulings of law.

Comments on the proposed amendments should be directed to the Standing Advisory Committee on the Rules of Civil Procedure, c/o Christine P. Burak, Supreme Judicial Court, John Adams Courthouse, One Pemberton Square, Boston MA 02108 on or before January 23, 2009. Comments may also be sent to christine.burak@sjc.state.ma.us
After reviewing the comments submitted, the Standing Advisory Committee will make its recommendations to the Supreme Judicial Court with respect to the proposed amendments.
