Proposed Amendment to
Rule 3:03 of the Rules of the Supreme Judicial Court

The Supreme Judicial Court 's Rules Committee invites comments on a proposed amendment to Rule 3:03 of the Rules of the Supreme Judicial Court.

The proposed amendment to S.J.C. Rule 3:03 (1)(a) would add the Probate and Family Court to the courts in which a senior law student qualified under the rule could appear on behalf of the Commonwealth or an agency of the Commonwealth provided proper supervision is in place.

Comments on the proposed amendment should be directed to Christine P. Burak, Secretary, Supreme Judicial Court Rules Committee, Supreme Judicial Court , John Adams Courthouse, One Pemberton Square , Boston MA 02108 on or before July 6, 2012. Comments may also be sent to christine.burak@sjc.state.ma.us.

Proposed amendment to Rule 3:03(1)(a) of the Supreme Judicial Court (new language underlined):

S.J.C. Rule 3:03

(1)(a) on behalf of the Commonwealth (including a subdivision of the Commonwealth or an agency of the Commonwealth or of a subdivision)in proceedings in any division of the District Court, Juvenile Court, Probate and Family Court or Housing Court Departments or in the Boston Municipal Court Department, provided that the conduct of the case is under the general supervision of a member of the bar of the Commonwealth who is a regular or special assistant district attorney, a regular or special assistant attorney general, an agency counsel or assistant agency counsel, or a corporation counsel, city solicitor, town counsel, assistant municipal counsel or assistant solicitor;
