Investigation into the death of Jarrod J. Mooney

HINGHAM, MA   On Thursday, July 10, 2008, at approximately 8:28 P.M., the Hingham Police Department received a call from Hull Police reporting that a motor vehicle was speeding into Hingham.

The speeding vehicle, a Buick that had been stolen in Quincy earlier in the day, had just left the scene of a hit and run in the town of Hull.   The Hull Police pursued the stolen Buick for approximately one mile on George Washington Boulevard in Hull.   The stolen Buick then continued at a high rate of speed into the town of Hingham.

A few minutes later, the Buick crossed into the on-coming eastbound lane of traffic and struck a minivan.   The driver of the stolen Buick, Jarrod J. Mooney, (DOB 12-15-82), was taken to an area hospital where he was pronounced dead a short time later.

The driver of the minivan, a female from Hingham, was taken to an area hospital and appears to have non-life threatening injuries.

The case is under investigation by State Police Detectives assigned to the Plymouth County District Attorney's Office.   The State Police Accident Reconstruction Team also responded.

There will be no further comment at this time.

18 individuals are arrested for the sale and distribution
of illegal narcotics in the City of Brockton

BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz today announced the arrest of 18 individuals for the sale and distribution of illegal narcotics in the City of Brockton.   The arrests follow an investigation by the State Police Gang Unit and the Brockton Police Department.

The arrest warrants were executed yesterday in a coordinated effort by members of the State Police Gang Unit assisted by the State Police Detective Unit assigned to the Plymouth County District Attorney's Office, the Brockton Police Department, the Federal Bureau of Investigations, Massachusetts Parole, and the State Police Community Action Team
(D-CAT).   Over 50 law enforcement agents swept the streets of Brockton searching for the wanted defendants.

The investigation was funded largely through the Brockton Weed and Seed grant which is administered by District Attorney Cruz's office.   Weed and Seed is a Department of Justice grant initiative to help communities weed out drug and criminal activity, while seeding in community programs and neighborhood restoration efforts.   It was also funded by Project Safe Neighborhoods, which was initiated by President Bush in 2001, and is a nationwide commitment to reduce gun crime in America by networking existing local programs that target gun crime and provides these programs with additional tools necessary to be successful.

District Attorney Cruz stated,   "The State Police Gang Unit is to be commended for their hard work in this investigation.   Once again, they have sent a strong message to those who want to peddle drugs and violence in this City that their behavior will not be tolerated.   We are watching you and we will put you out of business and behind bars.   I also want to commend the Brockton Police Department, the State Police Detectives from my office, the Federal Bureau of Investigations, Massachusetts Parole, and the State Police Community Action Team (D-CAT) who helped arrest these defendants.   I cannot emphasize enough that these officers put their own lives at risk in order to rid the streets of Brockton from drug dealing and the violence it brings.   I am very pleased with the swiftness and professionalism with which these arrests were effectuated."

    United States Attorney Michael J. Sullivan said, "Those who are involved with gang violence, drugs and illegal guns should heed today's message:  If you use, carry, possess or distribute drugs or guns in the City of Brockton, if you threaten the safety of this community - we will arrest you and prosecute you using the full array of federal and state resources at our disposal.   The law abiding, decent and good people of Brockton deserve nothing less, and we will not stand by and allow a handful of criminals to disrupt the lives and neighborhoods of this community."

    "The Massachusetts State Police and our law enforcement partners will not allow drug dealers to diminish the quality of life for the Brockton community.   We will harness our collective efforts, today and every day, to take back the streets from drug peddlers" stated Colonel Mark F. Delaney, Superintendent of the Massachusetts State Police.

    Special Agent in Charge of the Federal Bureau of Investigations, Warren T. Bamford, said, "The FBI will continue to work with our law enforcement partners to eradicate gangs in our communities.   The criminal activities of these groups have a disparate impact on the quality of life and must be vigorously investigated."

    PLYMOUTH, MA   Plymouth Police received a call today at 6:43 a.m. to respond to
    11 Savery Lane in Plymouth for a call of a deceased male.

    Upon arrival, police found Michael K. Shea (DOB 7-28-58) deceased in his home.
    There will be an autopsy later today to determine the cause and manner of death.

    The case is under investigation by the State Police Detectives assigned to the
    Plymouth County District Attorney's Office and the Plymouth Police Department.

    Investigators will await the autopsy result to determine if the death is suspicious.

    Shooting on Turner Street in Brockton

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that there was a fatal shooting in the city of Brockton last night.

    At approximately 11:02 p.m., Brockton Police received a call regarding shots fired in the area of 64 Turner Street.   Upon arrival, police found the victim in the yard between 51 and 69 Turner Street.   The victim, later identified as Bensney Toussaint (DOB 3-3-82) of 25 Clarence Street, Brockton, appeared to be suffering from gun shot wounds to the chest.
    He was transported to a local hospital where he was pronounced dead.

    The case is being investigated by State Police Detectives assigned to the Plymouth County District Attorney's Office and Brockton Police Detectives.   No one is under arrest at this time.

    Roy L. Hunt of Brockton, is found to be a Sexually Dangerous Person
    under MGL. Ch.123A, Sec.1, 12-16 by a Brockton Superior Court Jury

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that a Brockton Superior Court Jury, has found Roy L. Hunt, (DOB 1-11-58) of Brockton,
    to be a Sexually Dangerous Person under Massachusetts General Law, Chapter 123A, Section 1, 12-16.

    Hunt pleaded guilty in 1990 to three counts of Rape of Child.   He was sentenced to serve
    8-15 years in prison.

    On June 4, 2004, at the conclusion of his sentence, prosecutors filed a petition to have
    Hunt committed as a Sexually Dangerous Person under Massachusetts General Law, Chapter 123A, Section 1, 12-16.

    The trial on the Commonwealth's petition began on May 27, 2008 in Brockton Superior Court and concluded on June 3, 2008.    There were six expert witnesses and 22 exhibits entered into evidence.

    The jury deliberated for approximately three hours before retuning with a finding beyond a reasonable doubt that Hunt was a Sexually Dangerous Person.   Hunt was committed to the treatment center at Bridgewater State Hospital for one day to life.   Judge Jeffrey Locke presided over the proceedings.

    The United States Attorney's Office to address local gun and gang problems

    BROCKTON, MA    Plymouth County District Attorney Timothy J. Cruz announced receiving an award of $100,000 from the Office of United States Attorney Michael J. Sullivan.

    This funding comes from the Department of Justice Project Safe Neighborhood (PSN) Initiative.

    Project Safe Neighborhoods is a nationwide commitment to reduce gun crime in America by networking existing local programs that target gun crime and providing these programs with additional tools necessary to be successful.

    The Bush Administration committed over $1.5 billion to this effort since PSN's inception in 2001.   This funding is being used to hire new federal and state prosecutors, support investigators, provide training, distribute gun lock safety kits, deter juvenile gun crime, and develop and promote community outreach efforts as well as to support other gun violence reduction strategies.

    The $100,000 grant will be used to continue this important work in the city of Brockton.
    The funds will support prevention and outreach programs, as well as fund criminal investigations by the State Police and Brockton Police.

    District Attorney Timothy J. Cruz stated, "These funds will go a long way in helping us continue our multi-front battle against the gun and street violence that has plagued the city of Brockton.   The funds will help us reduce firearm related crime and violence by identifying the hot spots where the violence occurs, as well as, those serious repeat offenders who create most of the violence.   On the prevention side, these funds will allow us to continue to support community and faith based outreach programs, to provide training and technical assistance in gang awareness for the faculty of the Brockton Public Schools and to support the Mayor's Summer Faith Based Youth Employment program".

    "This grant exemplifies the collaboration that currently exists between all levels of government," said Mayor James E. Harrington. "Our youth face all kinds of barriers in their daily lives; this grant will without a doubt help ease the stresses placed by our budgetary constrains and allow us to augment the services that we are currently providing to the children of Brockton".

    The First Degree Murder conviction of Michael T. Burnham for the 1985 murder of 21 month old Rachelle Pelletier, is upheld by the Supreme Judicial Court

    BROCKTON, MA   The Supreme Judicial Court today upheld the First Degree Murder conviction of Michael T. Burnham for the 1985 murder of 21 month old Rachelle Pelletier. Rachel Pelletier died on March 7, 1985, from peritonitis caused by a traumatically severed small intestine.   At the time of her death Rachelle also had bruises on her forehead, cheek, chin, left shoulder, abdomen and right thigh.

    The case remained unsolved until May 2002, when a Plymouth County Grand Jury indicted Burnham and Rachelle's mother, Margaret Earle, for her murder.

    A Brockton Superior Court jury convicted Burnham in 2005 of murder in the first degree by extreme atrocity and cruelty for stomping on the toddler's abdomen and severing her small intestine.

    Margaret Earle, who was tried separately, was convicted of 2nd degree murder for failing to get Rachelle medical care. Her appeal is pending.


    Plymouth County District Attorney Timothy J. Cruz stated:

    "This defendant viciously stomped on a defenseless child and left her to die.

    As the court noted in its opinion, the facts in this case warranted nothing short of a finding of murder.

    As a result of the hard work of prosecutors and investigators, Michael Burnham will spend the rest of his life in prison.   There is finally justice for Rachelle Pelletier."

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest and arraignment of Jeffrey Milton (DOB 10-19-90), of 28 Massasoit Ave, Brockton.

    Milton is charged with murder, attempted armed robbery and unlawful possession of a firearm in connection with the February 16, 2008, shooting of Brockton cab driver,
    Edward Conley.

    Milton turned himself in, to investigators at the Brockton Police Department on Saturday, May 24, 2008 at approximately 7:00 p.m.   He was arraigned today in the Brockton District Court.   He entered pleas of not guilty.

    The next court date is on June 17, 2008, for a Probable Cause Hearing.

    No further comment will be made at this time.

    Norman J. Finizio, of Halifax, MA is arrested and arraigned in District Court
    on a charge of Indecent Assault and Battery on a Child Under the Age of Fourteen

    HALIFAX, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest and arraignment of Norman J. Finizio, (DOB 04-19-62), of 1 White Island Road in Halifax.

    Finizio is charged with one count of Indecent Assault and Battery on a Child Under the Age of Fourteen.   The indecent assault and battery took place at the defendant's home approximately one year ago.   The female victim was nine years old at the time.
    She is not related to the defendant.

    Halifax Police began investigating the case on Monday, May 19, 2008.   Today, they sought and obtained an arrest warrant from the Plymouth District Court charging the defendant with one count of Indecent Assault and Battery on a Child Under the Age of Fourteen.

    The defendant was arrested without incident later today in Quincy.   He was booked at the Halifax Police Department and then transported to the Plymouth District Court for arraignment.   The defendant entered a plea of not guilty.

    Prosecutors moved to have the defendant held without bail pursuant to the dangerousness statute.

    A dangerousness hearing is scheduled for Wednesday May 28, 2008.    The defendant is being held without bail pending the hearing.

    Antonio Fernandes is arrested for

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest of Antonio Fernandes, (DOB 9-9-91), of Brockton, for the February 16, 2008 fatal shooting of Edward Conley, (DOB 10-30-51), which took place on Galen Street in Brockton.

    On Friday, May 16, 2008, Brockton and State Police Detectives sought and obtained an arrest warrant from the Brockton District Court charging the defendant with one count of murder, attempted armed robbery and unlawful possession of a firearm.

    The defendant was located by Detectives in the area of Center Street and Massasoit Avenue in Brockton.   He was arrested without incident.

    Antonio Fernandes was arraigned today in the Brockton District Court, and was held
    without bail.   The next court date is June 19, 2008 for a Probable Cause Hearing.

    The case is being prosecuted by Assistant District Attorney Lewis Armistead.

    Two Brockton men are found guilty on various narcotics offenses in
    Superior Court.  Each receive a sentence of 15 to 17 years in State Prison

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that two Brockton men were sentenced to 15 to 17 years in State Prison yesterday after being found guilty of various narcotics offenses in Brockton Superior Court.

    Jeffrey Transtamar, (DOB 09-02-83), of Brockton, was found guilty of one count of Trafficking in over 200 grams of Class B Cocaine and two counts of Distribution of
    Class B in a School Zone.   He was sentenced to 15 to 17 years in State Prison.

    Ricardo Charles, (DOB 02-20-79), of Brockton was found guilty of Trafficking in
    over 200 grams of Class B Cocaine.   He was sentenced to 15 to 17 years in State Prison.

    The convictions followed a 3 day jury trial in Brockton Superior Court before
    Judge Geoffrey Locke.

    The charges stemmed from an August-September 2006 investigation by the State Police into narcotics distribution in the city of Brockton.   The investigation included two undercover purchases of cocaine which occurred in August and September of 2006.

    A search warrant was also executed in September 2006 at 9 Burton Street, 1st floor, Brockton.   As a result of the warrant, police found 700 grams of crack and powder cocaine in the kitchen area of the 9 Burton Street location.   They also found 500 grams of crack and powder cocaine on the rooftop of 11 Burton Street.

    The investigation was headed by State Police Sgt. James Gilmore and Trooper Michael McCarthy.   The case was prosecuted by Assistant District Attorney Russell Eonas.

    ABINGTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest of John Tassinari (DOB 9-11-78) of 55 Pilgrim Street, Abington, Massachusetts, for the April 22, 2008, shooting death of his wife, Barbara Tassinari (DOB 12-21-78).

    At approximately 10:10 p.m. last night, Abington Police received a call concerning a shooting at 55 Pilgrim Street.   Officers responded to that location and found the victim,
    Barbara Tassinari, deceased in the back yard.

    She appeared to have suffered gunshot wounds to the head.   John Tassinari was taken into custody at the scene.

    John Tassinari has been charged with one count of Murder.   He will be arraigned today in the Brockton District Court.

    An autopsy will be conducted today by the Office of the Chief Medical Examiner to determine the cause of death.

    The case is under investigation by the State Police Detectives Assigned to the Plymouth County District Attorney's Office in conjunction with the Abington Police.

    Investigation into the death of Paul Richard Noble

    BROCKTON, MA   At approximately 10:20 p.m., Brockton Police responded
    to the area of Pine Street and Jacob Street in Brockton, for a call of a man lying
    in the middle of Jacob Street.

    Upon arrival, officers found Paul Richard Noble, (DOB 12-31-69), of Brockton
    lying in the street with what appeared to be extensive facial trauma.   He was taken
    to a local hospital where he was pronounced dead.   There will be an autopsy later
    today to determine the cause of death.


    The case is being investigated by the State Police Detective's Unit assigned to the
    Plymouth County District Attorney's Office in conjunction with the Brockton Police Detectives.

    William R. Suarez is arrested in connection
    with the shooting of 15 year old male, in Brockton

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that William R. Suarez, (DOB 10/2/89), of 317 Battles Farm Drive in Brockton, has been arrested in connection with the shooting of a 15 year old male in Brockton yesterday.

    At approximately 5:46 p.m., Brockton Police responded to 317 Battles Farm Road for a shooting.   The victim Oliver Baptiste, DOB 8/2/92, of 309 Battles Farm Drive, had suffered what appeared to be a gunshot wound to the head.   He was pronounced dead at an area hospital at approximately 6:45 p.m.

    William Suarez has been charged with manslaughter, illegal possession of a firearm, assault with a dangerous weapon, and discharging a firearm within 500 feet of a dwelling.

    He was arraigned today at the Brockton District Court and ordered held on $1,000,000.00 bail.   The case is next scheduled for probable cause hearing on April 23, 2008 at the Brockton District Court.

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest of Adilson Neves, (DOB 4-20-90), of 59 Plymouth Street in Brockton, for the February 16, 2008, murder of Edward Conley.

    Edward Conley was shot in the back of the head as he sat in his taxi cab on Galen Street in Brockton on February 16, 2008.   Neves has been charged with Murder, Unlawful Possession of a Firearm and Attempted Armed Robbery.

    He will be arraigned this morning in the Brockton District Court.

    Two Charged in Child Abuse Case in Middleboro

    MIDDLEBORO, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that Michelle Henry, (DOB 1-6-78), of 8 Archer Court, Middleboro was arrested today and charged with one count of assault and battery on a child causing injury and one count of reckless endangerment of a child. She will be arraigned this afternoon in Wareham District Court.

    Additional charges have also been taken out against David Privette (DOB 8-25-85), charging him with one count of mayhem and two counts of indecent assault and battery on a child. He will be arraigned on Monday, March 24, 2008 in Wareham District Court.

    Shooting on Essex Street in Brockton

    BROCKTON, MA   On February 19, 2008 at approximately 5:11 p.m., Brockton Police Detectives responded to Essex Street in Brockton for a call of a person shot.

    Upon arrival officers found two victims suffering from apparent gun shot wounds in the backyard of a residence.    The victims were later identified as Terrance Young, (DOB 6-13-92), of 50 Julien Street, Boston, and Darryl Jackson, (DOB 6-8-88), of 50 Julien Street, Boston.

    Both victims were transported to area hospitals.    Young was pronounced dead a short time later at Brockton Hospital.  Jackson underwent surgery on his right arm and is in stable condition.

    The case is under investigation by the State Police Detectives assigned to the Plymouth County District Attorney's Office and Brockton Police Detectives.

    "Our investigators are working around the clock on this shooting, but we need cooperation from witnesses.    The cooperation of witnesses to this and other shootings would go a long way in solving these crimes" said District Attorney Timothy J. Cruz.

    Shane Bester, wanted for the January 8, 2008

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced that Shane Bester (DOB 10-28-81) who is wanted for the January 8, 2008 murder of Adilson Pires has been apprehended by Florida authorities.

    As a result of information obtained from the ongoing investigation, Investigators developed information regarding Bester's location.   On Thursday, January 10, 2008, at approximately 9:45 p.m., Investigators contacted the Orange County Florida Deputy Sheriff's Department and asked them to check on a location in Orlando, Florida.   A short time later, on the same date, Shane Bester was found at that location and placed under arrest.

    The case has been under investigation by State Police Detectives assigned to the
    Plymouth County District Attorney's Office and Brockton Police Detectives.

    On January 9, 2008, investigators sought and obtained a warrant charging Bester with the murder of Adilson Pires.   Investigators have been searching for Bester since obtaining the warrant.   They are now seeking the public's help in locating him.

    Two Shooting Incidents in the City of Brockton

    BROCKTON, MA   There were two shooting incidents in the city of Brockton last night, Tuesday, January 8, 2008.    At this point in the investigations there is no indication that the two incidents are related.

    The first incident was reported at approximately 9:23 p.m.   Brockton Police received a call reporting a shooting at 430 Main Street, Brockton Massachusetts.   Upon arrival, uniformed Brockton Police personnel found the victim lying inside Giannaro's Discount Liquors with an apparent gunshot wound to the abdomen.   The victim was transported to a local hospital where he was pronounced dead.   He was positively identified early this morning as
    Adilson Pires, (D0B 06/14/83) of 59 Chester Street, Brockton.   An autopsy will be performed later today by the Office of the Chief Medical Examiner.

    The shooting is under investigation by the State Police Detectives assigned to the
    Plymouth County District Attorney's Office in conjunction with Brockton Police Detectives.

    A second incident was reported at 10:08 p.m.   At that time Brockton Police received a call for shots fired at 33 Falmouth Ave, Brockton, Massachusetts.   Upon arrival Brockton Patrol Officers and Massachusetts State Police CAT team Troopers found two victims in the street suffering from what appeared to be gunshot wounds.   Both victims were transported to the hospital.

    The victims were identified as Ronnell Lewis (DOB 12-20-77), of Randolph and Darron Hurt (DOB 08-16-86), of Taunton.   Lewis appeared to have been shot in the head and the torso. He was transported to a Boston hospital and is in critical condition.   Hurt appeared to have been shot in the head and the arm.   He was treated for non life threatening injuries.

    The case is under investigation by the State Police Detectives assigned to the
    Plymouth County District Attorney's Office in conjunction with Brockton Police Detectives.

    Emmanuel Okoro of Brockton, is arrested and charged with murder
    in the stabbing death of Markeen Starks of Brockton

    BROCKTON, MA   Plymouth County District Attorney Timothy J. Cruz, today announced the arrest of Emmanuel Okoro, (DOB 2-3-92), of 49 Otis Street, Brockton, for murder in connection with the January 1, 2008, stabbing death of Markeen Starks, (DOB 3-29-88) of
    58 Clinton Street, Brockton.   On January 1, 2008, at approximately 12:43 A.M., Brockton Police responded to 5-7 Skinner Street in response to a 911 call of a stabbing.   Upon arrival, they found the victim, Markeen Starks, lying in the street suffering from apparent stab wounds.   He was taken to an area hospital where he was pronounced dead.   An autopsy was conducted by the Office of the Chief Medical Examiner and the cause of death was determined to be multiple stab wounds.   The manner of death was ruled homicide.

    The case has been under investigation by State Police Detectives assigned to the District Attorney's Office and Brockton Detectives.   On January 1, 2008, detectives sought and obtained an arrest warrant from the Brockton District Court, charging Emmanuel Okoro with murder.   Today, the defendant surrendered to police at the Brockton Police station.   He is scheduled to be arraigned this afternoon at the Brockton District Court.
