REVERE SLAYING DEFENDANT HELD WITHOUT BAIL

An East Boston man will remain in custody pending his trial next year on charges that he stabbed two men after a party on Nahant Avenue, killing one and leaving another with life-threatening injuries, Suffolk County District Attorney Daniel F. Conley announced.

Superior Court Clerk Magistrate Gary D. Wilson ordered JOSE SANCHEZ MOZ, 27 (D.O.B. 2/23/80), held without bail following Moz’ arraignment today for the murder of Jose Amalcar Hernandez Rivera, 34, and the attempted murder of a surviving victim, 49, in the early morning hours of Nov. 2, 2007. Moz pleaded not guilty through a Spanish interpreter.

Moz was indicted Tuesday on charges of first-degree murder, armed assault with intent to murder, and aggravated assault and battery with a dangerous weapon. The indictment followed a three-month investigation by Revere Police detectives, State Police homicide detectives assigned to Conley’s office, and Suffolk County prosecutors.

In the course of that investigation, Assistant District Attorney Daniel Mulhern told Wilson, multiple witnesses stated that Moz, Rivera, the surviving victim, and others were present at a Nahant Avenue residence for a party on the night of Nov. 1. As the hour grew later, the party wound down and guests began to leave.

“The party began breaking up,” Mulhern told the Court, “and at some point Mr. Rivera was asked to leave. As Mr. Rivera was being escorted out, a small altercation broke out” between Rivera and others present. Moz was not part of that altercation.

The surviving victim came to aid Rivera, Mulhern said, and Moz became involved a short time later.

“At that point, the defendant intervened,” Mulhern said. “When he intervened, he picked up a knife.”

In the moments that followed, both Rivera and the surviving victim sustained a number of serious stab wounds.

“The order of the stabbings is unclear,” Mulhern said, “but [the surviving victim] was stabbed twice – once in the chest and once in the stomach. He spent a period of five to six days at Massachusetts General Hospital.”

Rivera, Mulhern continued, “was stabbed seven times. He sustained five stab wounds to the left part of his chest and twice in the area of his left arm. Of those five stab wounds to the chest, three of them were more than three inches deep.”

Revere Police observed the surviving victim bleeding heavily near a supermarket a short distance from the crime scene. They soon learned that another victim – later identified as Rivera – was also injured, and responded to the Nahant Avenue address to find him grievously wounded. Rivera was rushed to Whidden Memorial Hospital, where he was pronounced dead of his injuries a short time later.
