TEEN DRIVER CHARGED WITH DRIVING WHILE INTOXICATED Feb. 25, 2008 A 17-year-old Brookline High School senior was arraigned this morning on charges that he seriously injured a pedestrian after he allegedly hit her with his sport utility vehicle while driving under the influence of alcohol. At his Boston Municipal Court arraignment, ROBERT McGRATH (D.O.B. 3/27/90) was charged with one count each of operating a motor vehicle under the influence of alcohol causing serious injury and unlicensed operation of a motor vehicle. McGrath posted $2,500 following his arrest Sunday morning by Boston Police officers and walked into the courtroom this morning. Assistant District Attorney Patrick Devlin requested that the defendant be held on $25,000 cash bail; Municipal Court Judge Michael Coyne set bail at $2,500 and ordered that McGrath not operate a motor vehicle until or unless the Registry of Motor Vehicles reinstates his license, which is currently suspended. Additionally, the defendant must report in person to probation once a week and undergo random drug and alcohol testing. At about 2 a.m. on Feb. 23, Boston Police officers received a call for a pedestrian struck by a motor vehicle at 218 Commonwealth Avenue. Upon arrival, they encountered emergency medical service paramedics assisting an unconscious 21-year-old female victim, who was rushed to Massachusetts General Hospital in critical condition. The defendant, who was on the scene, was placed under arrest. Officers observed that McGrath had an odor of an alcohol on his breath, bloodshot eyes, and a slight slur in his speech. The 2006 black Toyota Rav sport utility vehicle registered to the defendant’s father had noticeable damage to the right front end, hood and windshield and was towed on the scene. Officers also observed what appeared to be some of the victim’s hair stuck to the windshield. Officers performed a field sobriety test on the defendant, which he failed three times, Devlin said. Police officers also administered a breathalyzer test and the defendant’s blood alcohol content was found to be above the legal limit. McGrath was represented by attorney Wayne Murphy. He is scheduled to return to court on March 25.
