ATTORNEY ACQUITTED OF ASSAULTING OFFICER

April 2, 2009

As his attorney urged a Boston Municipal Court judge to accept his 11th hour admission to facts sufficient for a finding of guilty, a jury of six Boston residents found GARY ZEROLA (D.O.B. 8/3/71) not guilty of assaulting a police officer.

Suffolk prosecutors introduced evidence and testimony suggesting that a Boston Police officer stopped Zerola on June 18, 2008, near the intersection of State and Congress streets with the belief that he was urinating in public. Testimony indicated that he pushed the officer and ran away before being taken into custody.

As the jury deliberated this afternoon, Zerola’s attorney, Raymond Buso, urged Judge Annette Forde to continue the case without a finding for a period of one year; Forde refused, saying that it was “too late” and noting that the jury had reached a verdict.

Assistant District Attorney Patrick Devlin represented the Commonwealth at trial.
