Well
Drillers Program
In 1962, the legislature enacted Massachusetts General Law Chapter
21, Section 16 establishing a registration system for well drillers
and the filing of well completion reports. The purpose of this
law is to protect the Commonwealth's groundwater resources from
impairment by ensuring that productive and non-productive wells
are drilled, constructed, altered, or
decommissioned
properly. The law
also assists consumers by requiring that all well drillers have
professional qualifications in their field. To accomplish this,
313 CMR 3.00 establishes qualifications for registration and responsibilities
of well drillers, requires certain information to be filed upon
completion of wells, and establishes criteria whereby a registration
can be suspended or revoked.
The Office of Water Resources, in the Department of Conservation
and Recreation, is responsible for implementing and enforcing the
law and regulations by administering well driller exams, maintaining
a well completion report database, and responding to complaints
regarding persons engaged in the business of well drilling. The
office also provides assistance to local boards of health to ensure
that well drillers operate in conformance with local requirements.
