Crow Lane Landfill Project Update - February 3, 2010
MassDEP is updating the webpage today to include three documents:
A 72 Hour Notification dated January 26, 2010 issued by MassDEP pursuant to the Settlement Agreement and Final Judgment in Commonwealth v. New Ventures Associates, LLC, Suffolk Superior Court C.A. 06-0790 C, as amended by Orders of the court on May 27, 2009 and October 7, 2009 (the "Final Judgment") to New Ventures regarding deficiencies at the Crow Lane Landfill including, without limitation, deficiencies with the landfill gas collection system;

Crow Lane Landfill Project Update - December 23, 2009
MassDEP is updating the webpage today to include electronic copies of technical revisions of the Final Corrective Action Design Plans filed in Suffolk Superior Court on October 6, 2009. As part of the revisions, New Ventures proposed to extend the Flexible Membrane Liner (FML) cap to cover the top of the berm to improve storm water control. These revised plans replace the Final Corrective Action Design Plans previously entered by the Court on April 30, 2009.

Crow Lane Landfill Project Update - October 14, 2009
MassDEP is updating the webpage today to include the October 6, 2009 deficiency notice issued by MassDEP to New Ventures on the MSE Berm design modification plan and supporting geotechnical evaluation submitted by New Ventures pursuant to paragraph 12a.(v) of the Final Judgment entered in Suffolk Superior Court, on April 30, 2009, for the closure of the Crow Lane Landfill. The MSE Berm design modification, dated August 26, 2009, was prepared by SITEC Environmental of Marshfield, Massachusetts, and the supporting geotechnical evaluation titled: "Report on Additional Geotechnical Analysis Crow Lane Landfill Newburyport, Massachusetts", dated August 20, 2009, was prepared by GEOCOMP Corporation (GEOCOMP) of Boxborough, Massachusetts, for the Crow Lane Landfill. Paragraph 12a.(vi) of the Final Judgment requires that New Ventures submit a revised MSE Berm design modification plan to MassDEP within 15 days of the MassDEP's deficiency notice.

Crow Lane Landfill Project Update - July 20, 2009

Final Judgment and Settlement Agreement - April 30, 2009
On April 30, 2009, Superior Court Judge Peter Lauriat entered in Suffolk Superior Court a consent judgment for the Crow Lane Landfill in Newburyport, Massachusetts. The consent judgment resolves the case brought by the Commonwealth against New Ventures Associates, LLC in February 2006 for violating MassDEP enforcement orders that resulted in the release of odoriferous hydrogen sulfide gas at the Crow Lane Landfill and nuisance odors in residential neighborhoods in the area of the landfill.
The consent judgment sets an enforceable schedule for capping the landfill with an impermeable flexible membrane by the end of the year, with key interim milestones. The consent judgment also includes the final corrective action design plans for construction of the landfill closure and requires that the landfill conduct a geotechnical program to evaluate the existing berm and the area where the MSE berm will be constructed, and then construct a critical portion of the berm within 90 days of MassDEP's approval of the geotechnical evaluation. If the test results demonstrate that a design modification is necessary, the berm must be built within 90 days of MassDEP's approval of a new berm design stabilization plan.
The judgment includes performance standards for continued operation of the air pollution control equipment, as well as various measures to prevent odor problems from occurring during completion of the landfill's closure. In addition, to further induce compliance, the consent judgment provides that portions of the $230,000 penalty will be suspended if New Ventures meets six key closure milestones at the Crow Lane landfill.

Preliminary Injunction - September 20, 2007
On September 20, 2007, Superior Court Judge David A. McLaughlin issued a decision on the Attorney General Office's July 27, 2007 motion asking the court to grant the MassDEP access to the landfill to conduct measures to control the release of landfill gas and hydrogen sulfide from the Landfill. The court denied the Commonwealth's request that MassDEP be granted access to the landfill to conduct measures to control the release of landfill gas and hydrogen sulfide. The court instead issued a preliminary injunction ordering New Ventures to take several steps to control hydrogen sulfide emissions at the landfill including placing a temporary cap on part of the landfill and installing three new gas extraction wells to control noxious odors from the uncapped portions of the landfill.

On July 4, 2007 the MassDEP issued a Notice of Noncompliance to New Ventures pursuant to paragraph (9) of the preliminary injunction entered on October 20, 2006 in Suffolk Superior Court, Civil Action No. 06-0790 C, as amended by order of the Court on November 1, 2006 and February 22, 2007 (the "Order") with regards to activities occurring at the Crow Lane Landfill (the "Landfill") in Newburyport, Massachusetts. The Notice of Noncompliance notified New Ventures that it is in noncompliance with one or more provisions of the Order and that New Ventures shall not resume the receipt and placement of C&D Fines and Residuals at the landfill until MassDEP approves the resumption in writing. Notice of Responsibility and Response Action
On July 2, 2007, the MassDEP issued a Notice of Responsibility and Notice of Response Action (NORA) to New Ventures Associates, LLC and Mr. William Thibeault (individually) directing them to undertake response actions at the Crow Lane Landfill to control and mitigate the continuing release of landfill gas from the site. The NORA requires that New Ventures and Mr. Thibeault respond in writing to the MassDEP by July 16, 2007. The NORA provides that if their response is inadequate or incomplete, or they fail to undertake the necessary response actions in accordance with the MCP, MassDEP may perform the necessary response actions and take appropriate legal action against them, including cost recovery activities. In addition, MassDEP issued notice (Notice of Intent) to New Ventures in accordance with the Financial Assurance Mechanism and the Standby Trust Agreement for the project of the MassDEP's intent to inform the Trustee of the Standby Trust that New Ventures has failed to perform closure or corrective action activities required by the MassDEP. These are the initial steps that are required for the MassDEP to conduct response actions at the landfill. In correspondence dated July 9, 2007, New Ventures requested an extension of the deadline to respond to the NORA, which MassDEP denied on July 10, 2007. New Ventures responded to the NORA and Notice of Intent on July 16, 2007.

Crow Lane Landfill Litter Control Plan - May 30, updated July 19, 2007
On July 10, 2007, New Ventures Associates, LLC appealed the MassDEP's June 12, 2007 final decision on New Ventures April 25, 2007 Litter Control Plan for the Crow Lane Landfill. As discussed below, on May 2, 2007, MassDEP had previously approved the plan. By letter dated May 21, 2007 New Ventures had requested that the MassDEP reconsider the conditions imposed by the May 2, 2007 decision. The MassDEP's June 12, 2007 decision approved the Litter Control Plan subject to the conditions that New Ventures:
- Place and maintain on active areas of the landfill at the end of each working day at least one of the following: (a) not less than six (6) inches of soil that does not contain any C & D Fines and Residuals, solid waste, or litter; (b) impervious tarps; or (c) poly sheeting at least 11 millimeters thick.
- Inspect the landfill and off-site abutting areas at the beginning of each workday for litter and remove any excessive litter identified during this inspection by the end of that workday. Record the inspection(s) and the removal of the litter daily, and place and maintain the record onsite in the facility's records.

Crow Lane Landfill Project Update - May 9, 2007
On May 7, 2007, New Ventures submitted a revised design plan to MassDEP for the permanent connection of the enclosed flare to the landfill gas collection and pre-treatment systems. This design modified designs previously submitted to MassDEP by New Ventures' engineer on March 1, 2007 and April 30, 2007. On March 23. 2007, the MassDEP had approved the March 1, 2007 design subject to the conditions that the design include installation of a stand pipe and liquid high level alarm in the condensate collection tank. The April 30, 2007 design included the required stand pipe but did not include the high level alarm. On May 7, 2007, the MassDEP approved the May 7, 2007 design that included both the stand pipe and the high level alarm.

Crow Lane Landfill Project Update - May 2, 2007
On April 25, 2007, New Ventures submitted a Litter Control Plan to MassDEP in response to the Unilateral Administrative Order (UAO) MassDEP issued to New Ventures on April 12, 2007 for failing to control wind blown litter. The MassDEP's decision approves New Ventures' Litter Control Plan subject to the conditions that New Ventures:
- Comply with the tarp placement requirements of paragraph 1(j) of the preliminary injunction entered on October 20, 2006 in Suffolk Superior Court, Civil Action No. 06-0790 C, as amended by the Court on November 1, 2006 and February 22, 2007 (the "Order");
- Place and maintain not less than six (6) inches of soil that does not contain any C & D Fines and Residuals, solid waste, or litter on active areas of the landfill at the end of each working day; and
- Inspect the landfill and off-site abutting areas at the beginning of each workday for litter and remove any excessive litter identified during this inspection by the end of that workday.
In addition, on May 2, 2007 the MassDEP issued a decision denying New Ventures' April 27, 2007 request for a Force Majeure pursuant to Paragraph 16 of the Order for placement of the tarps on the landfill. New Ventures contends that it is unable to maintain the tarps on the landfill surface due to the repeated occurrence of "gale force" winds.

Crow Lane Landfill Project Update - April 12, 2007
On April 12, 2007, the MassDEP notified New Ventures Associates, LLC that they are not in compliance with provisions of the preliminary injunction entered on October 20, 2006 in Suffolk Superior Court, Civil Action No. 06-0790 C, as amended by the Court on November 1, 2006 and February 22, 2007 (the "Order"). Pursuant to paragraph 9 of the Order, the notice requires New Ventures to cease receipt or placement of Construction and Demolition fines and residuals at the landfill, until MassDEP determines that New Ventures has returned to full compliance. In addition, MassDEP issued a Unilateral Administrative Order (UAO) for failing to control wind blown litter from the landfill in compliance with the Solid Waste Regulations and directing New Ventures to institute measures to control windblown litter from the landfill. The UAO was accompanied by an Administrative Penalty of $14,800 for New Ventures' failure to control windblown litter at the landfill in accordance with the Solid Waste Regulations.

Perimeter Berm Design - March 7, 2007
On March 7, 2007, MassDEP determined that the geotechnical evaluation of the berm at the Crow Lane Landfill did not provide sufficient information for MassDEP to complete its review. As a result, a Notice of Deficiency was issued requesting additional information which in addition to addressing MassDEP's concerns, also took into consideration comments provided by Metcalf & Eddy Inc., submitted on behalf of the City of Newburyport. Specifically in order to demonstrate that this structure will remain stable over time, MassDEP has requested additional information for the berm foundation, berm construction, reinforced earth wall design, and a Construction Quality Assurance Plan.

On February 21, 2007, MassDEP, the Office of the Attorney General, and New Ventures agreed to amend the Preliminary Injunction entered on October 20, 2006 in Commonwealth of Massachusetts v. New Ventures Associates, LLC, Suffolk Superior Court, Civil Action No. 06-0790 C, as amended by order of the Court on November 1, 2006 (the "Order") as follows:
1 New Ventures is required to establish an Interim Operation Plan with precise procedures for the operation of aspects of the landfill gas extraction system so that the system meets the performance standards that have already been established in Appendix A.
2. New Ventures is required to submit to the MassDEP for review and approval a design plan for the permanent connection of the landfill gas pretreatment system and enclosed flare to the permanent header of the landfill gas system. Page 4 of the Amended PI requires specific design elements which allow continuous operation of the other two pretreatment tanks in series when any one pretreatment tank is shut down, and, further, that shut down of any pretreatment" tank does not require a shut down of the enclosed flare or a disconnection of the piping to the tanks and the enclosed flare."
3. New Ventures is required to provide for the implementation and installation of temporary storm water controls for the management and control of storm water runoff from the capped Phase I and Phase II Areas of the landfill.
As a result, on February 21, 2007, the MassDEP authorized New Ventures to resume the placement of C&D Fines and Residuals at the Crow Lane Landfill. The amended Order was entered by the Suffolk Superior Court on February 22, 2007.

Area To Be Permanently Capped Expanded - December 7, 2006
Summary: New Ventures has proposed to expand the area to be permanently capped during the Phase 1 and 2 capping required by the October 20, 2006 Preliminary Injunction by approximately 1.5 acres. Paragraph 1.r. of the Order requires the Phase 1 and 2 capping to be completed by January 3, 2007. Expanding the capped area will reduce the generation of leachate and landfill gas by prohibiting precipitation infiltration into the landfill. Crow Lane Landfill Project Update - November 30, 2006
Summary: Today New England Liner Services is completing the laying of the Geocomposite gas vent layer (Geocomposite) and fabric cap liner (FML) in the Phase I Area. The anchoring of the Geocomposite and FML in perimeter anchor trenches is in progress on the south edge of the Phase I Area at the top of the landfill. New Ventures intends to commence the installation of the above ground valves and piping to connect the Geocomposite to the landfill gas extraction system after the completion of New England Liner Services placement of the FML and the anchoring trench at the top of the landfill.
Preparation of the Phase II Area for the installation of the Geocomposite and FML began on Monday with the commencement of grading and shaping in the northern portion of this area. New Ventures has scheduled the return of Iovino Excavating, the landfill gas trench contractor to the landfill for Monday to begin the installation of the landfill gas trenches and piping in the Phase II Area. On Wednesday, New Ventures resumed the receipt and placement of C & D material for the purpose of shaping and grading the Phase II Area. New Ventures has also been receiving soil at the site this week. Additional tarps have been placed on the landfill surface on the south side of the landfill along Crow Lane and the haul road.
MassDEP's contractor continues to monitor the shipment of the C & D material from Wood Waste of Boston to the landfill and the activities at the landfill (daily, Monday through Friday). This monitoring will continue.
The landfill gas extraction wells in the Phase II Area, including the two newly installed wells, have been connected to the landfill gas extraction system with a new temporary header and all the wells are now operational. The first pre-treatment vessel for the temporary 24 hour per day/7 day per week system has arrived at the site and will be connected to the landfill gas extraction system. New Ventures plans to use the new vessel in conjunction with the existing treatment vessel pending arrival and installation of a second pre-treatment vessel. The new vessels will utilize sulfur-treat as the pre-treatment media. The current pre-treatment tank utilizes sulfur-bind (a regenerative media) as the pre-treatment media.
Crow Lane Landfill Project Update - November 22, 2006
Summary: Today New England Liner Services commenced installation of the Geocomposite gas vent layer and fabric cap (FML) within the Phase I area at the Crow Lane Landfill. The installation will continue on Friday and Saturday and again next week, weather permitting. It consists of the placement of the Geocomposite gas vent layer and the FML (flexible membrane liner) on the landfill surface, and the anchoring of the Geocomposite and FML along the boundaries of the Phase I Area in anchor trenches. The anchor trenches will be excavated and backfilled continuously and will not remain open for extended periods.
The temporary tarps in the Phase II Area (western portion of the landfill) will remain in place through the weekend. Weather permitting, New Ventures will on Monday commence preparation of the Phase II Area for installation of the Geocomposite gas vent layer and FML. This will include the removal of tarps as necessary from the Phase II Area to allow the grading and shaping and the installation of the landfill gas trenches and associated landfill gas piping in the Phase II Area. In addition, landfill gas extraction wells EW-11 and EW-12 have been installed in the southwest portion of the landfill and New Ventures will proceed with connecting these wells to the existing landfill gas extraction system. The Geocomposite gas vent layer and FML installation will continue on the Phase II Area, as soon as possible after the area is prepared and the Phase I installation of the FML is completed.
Crow Lane Landfill Project Update - November 3, 2006
Summary: The severe winds experienced over the weekend of October 28, 2006 disrupted the placement of mats or tarps at Crow Lane landfill in Newburyport, a measure that was being undertaken to control odors. As a result of this damage the deadline for completing the placement of tarps was extended under the Force Majeure provisions of paragraphs 16 & 18 of the Department's October 20, 2006 Preliminary Injunction (PI) to November 6th.
In addition, through an amendment to the PI on November 1, 2006, New Ventures will be allowed to bring in up to 35 trucks a day of C&D fines to bring the Phase I & II areas of the landfill up to grade in order to expedite the final capping of these areas with a gas collection blanket and impervious liner. Representatives of the Department will be at both Crow Lane and the point of origin for the material, Wood Waste in Everett and will turn away any material that is not suitable. The completion of the Phase I and Phase II cap will be a significant step forward in controlling the ambient emission of landfill gas from the site and mitigating the occurrence of off-site odors.
Other requirements of the PI which have been complied with include:
- New Ventures executed a contract for the purchase and installation of the enclosed flare, and which included a down payment to the fabricator, Highland Power of Brockton, MA.
- New Ventures is operating the temporary landfill gas pretreatment system approximately 10 hours a day, 7 days a week.
- New Ventures established a $200,000 escrow account to ensure funding for a permanent enclosed flare.
- New Ventures is staffing the landfill 24/7.
- New Ventures has completed approximately 50% of the landfill gas vent trench installation in the Phase I Area.
- MassDEP representatives are present daily monitoring activities at the landfill and the shipment of C&D material from Wood Waste.

Preliminary Injunction
The Preliminary Injunction requires New Ventures Associates, LLC, to stop the spread of noxious hydrogen sulfide gas emissions at the landfill. The preliminary injunction requires New Ventures to install a state-of-the-art landfill gas extraction system, along with pretreatment controls and a new flare to burn off noxious landfill gas. The court's order also requires New Ventures to close the facility on an accelerated schedule, with half of the landfill capped by the end of the year, and the remainder capped by August 30, 2007.

Appendix D

Appendix D specifies the requirements for New Ventures to accept, for placement as final grading material at the Crow Lane landfill, C & D Fines and Residuals that have been produced at Wood Waste of Boston within 8 weeks prior to the date of the Preliminary Injunction (October 20, 2006) and were processed in accordance with the January 2006 gypsum removal protocol New Ventures submitted to the City of Newburyport Health Department.
