PUBLIC NOTICE

Notice is hereby given that the Department of Environmental Protection (Department), acting in accordance with the provisions of Massachusetts General Laws Chapter 30A, Chapter 111, Sections 142A through 142E, and 310 CMR 7.29, will hold a public hearing on the following action.

Pursuant to the Department's Air Pollution Control Regulations at 310 CMR 7.29, any person who owns, leases, operates or controls a coal fired electric generating unit (defined as an “affected facility”) shall submit to the Department an emission control plan (ECP) application describing how the affected facility will comply with the emission standards and applicable compliance dates contained in the regulation. The Department issued an Amended Emission Control Plan Final Approval dated October 20, 2004 to Dominion Energy Brayton Point, LLC (formerly USGen New England, Inc.) for the Brayton Point Station facility.

The Department hereby proposes to approve an Amended ECP Application and hereby issues an Amended ECP Draft Approval for:

Notice is hereby given that the Department intends to hold a public hearing on the action noted above for the purpose of receiving public comments on the Amended ECP Draft Approval.  The public hearing will be held as set forth below:

Time:                                  Public Hearing at 7:00 PM

Location:                             Somerset Middle School, 1141 Brayton Avenue
                                          Somerset, Massachusetts

Copies of the Amended ECP Draft Approval and Amended ECP application can be reviewed at the Department's Southeast Regional Office, 20 Riverside Drive, Lakeville, MA commencing on the date of this notice during normal business hours of 8:45 AM to 5:00 PM by calling John Winkler at (508) 946-2779 or the Southeast Regional Office Service Center at (508) 946-2714.  A copy of the Amended ECP Draft Approval is also available for review at the Board of Selectmen or the Board of Health in Somerset, MA, or from the Department's web site at:

The public hearing will be conducted under the provisions of Massachusetts General Laws, Chapter 30A.  Testimony may be presented orally and/or in writing no later than the conclusion of the public hearing and must be sent in writing to John Winkler, Permit Chief at the Department's Southeast Regional Office located at 20 Riverside Drive, Lakeville, MA 02347.
