310 CMR 7.28 & 310 CMR 7.32: NOx Allowance Trading & Massachusetts Clean Air Interstate Rule (Mass CAIR)
Please Note: In July 2008, a federal appeals court vacated the federal Clean Air Interstate Rule (CAIR) in its entirety. As a result, MassDEP proposed regulatory revisions that would reinstate its Nitrogen Oxides (NOx) Allowance Trading Program (310 CMR 7.28) through amendment and rescind the Massachusetts Clean Air Interstate Rule (Mass CAIR, 310 CMR 7.32).
In December 2008, the federal appeals court reversed its decision, instead leaving CAIR in effect and instructing the U.S. Environmental Protection Agency (EPA) to issue a new regulation addressing the flaws in CAIR that the court identified in its July 2008 decision.
Therefore, 310 CMR 7.32 (Mass CAIR) went into effect on January 1, 2009, and has replaced 310 CMR 7.28. MassDEP has withdrawn the amendments to 310 CMR 7.28 and rescission of 310 CMR 7.32 that it proposed in November 2008. No response to comments will be issued and no further action will be taken on these proposed regulation changes.
