BWSC108 Comprehensive Response Action Transmittal Form & Phase 1 Completion Statement
The BWSC108 form has been updated, incorporating many comments suggested by users. Below is a summary of the changes:
- Section B.16.c.i. now lists the Phase IV RMR check off box. It will not longer be necessary for users to make this submittal to MassDEP on paper and CD.
- Section B.19. Submit a Transfer and/or a Modification of Persons Maintaining a Remedy Operation Status (ROS) now includes check off boxes to:
a. Transfer a Remedy Operation Status. If this box is checked, it triggers the new sub form, BWSC108C, Remedy Operation Status Transferor Certification, to be signed by the person transferring the ROS (similar to the BWSC107C).
b. Add a Person Performing Response Actions. If this box is checked, it triggers the new sub form, BWSC108D, Modification of a Remedy Operation Status (ROS) To Add A Person Performing Response Actions Certification, to be signed by the additional (up to 3) person(s) performing response actions. If more than 3 additional persons need to be added, the user files additional BWSC108 forms.
- Section B.20. Submit a Termination of a Remedy Operation Status now includes check off boxes to:
a. Submit a Notice of ROS indicating ROS performance standards have not been met. If this box is checked, a plan and time table for resuming the ROS must be submitted.
b. Submit a Notice of Termination of ROS.
- Section E. Relationship to the Site of Person Undertaking Response Actions has been changed to let the user change the relationship. To change the relationship users would check off the change relationship box and enter the new information. The changes entered on the form impact this transmittal form only. To make the changes permanent in the DEP database, users must send an email to bwsc.edep@state.ma.us. indicating the RTN, the relationship to be changed and the person impacted. Please note that the relationships maintained in the DEP database are defined in MCP/21E.
