Audit Program - General Information What is an audit? An audit is a review of a document or submittal to verify that response actions have been conducted in compliance with MGL c. 21E and the Massachusetts Contingency Plan (MCP). A site could be randomly selected from a pool of submittals, or a submittal could be targeted for an audit.
What are the timeframes for DEP to conduct an audit? DEP has a two year window from the submittal of a Response Action Outcome (RAO) or Licensed Site Professional (LSP) Evaluation Opinion to conduct a random audit and five years from the date of a submittal to conduct a targeted audit. Exceptions to this rule are sites with Activity and Use Limitations, and sites where DEP has reason to believe that significant problems may be present.
What are the steps if my site is audited? In most cases, you will receive a Notice that your site is undergoing an audit. An auditor will review the file and conduct a site visit. You may be asked for clarification or further information to support the LSP Opinion. The Department will summarize its review in a Notice of Audit Findings which identifies any violations or deficiencies and actions necessary to correct them.
How long will it take? In general, a comprehensive audit will take between 4-6 weeks to complete, followed by the issuance of a Notice of Audit Findings. More complicated site conditions or issues can take much longer, especially if additional information is requested. A screening audit which is limited to checking compliance on a few limited items may only take a few days.
