MassDEP/LSP Association Course: A Different Path through the Massachusetts Contingency Plan, 2007

On Thursday, April 19, 2007 registration will open for five sessions of the upcoming course entitled "A Different Path through the Massachusetts Contingency Plan, 2007."  The five sessions of this course will take place on the dates noted below.  Each session begins at 8:00 am and ends at 12:00 pm.

The MassDEP and the LSP Association are currently seeking approval from the LSP Board for 4 hours of LSP "DEP/Regulatory" continuing education credit for this course. This is a New course. The price for each of the five sessions, which is limited to 100 attendees, is $200.

COURSE DESCRIPTION: The "ideal" 21E site is a rarity: a single property, easily identified release, straightforward site assessment, Method 1 risk characterization, timely RAO and invoices paid in cash. "Real" sites, however, require patience, flexibility and nuance. The Massachusetts Contingency Plan was designed with "real" sites in mind, incorporating a variety of investigatory pathways, alternative timelines and outcomes.  The Licensed Site Professional is their client's guide through this complexity.  This training session will address some of these different paths and outcomes.

  • Perchlorate and Emerging Contaminants - Reviewing the July 2006 regulations on perchlorate and the evaluation of "non-traditional" contaminants.
  • Downgradient Property Status - What kinds of sites are eligible? When are they eligible? What paperwork is required? What are the costs? What requirements does DPS relieve and what requirements remain?
  • Special Projects Designation - Covering the April 2006 changes to the Special Project, the session will discuss the process for extending deadlines using the SPD Permit, the limitations on who may apply for SPD Permits, criteria for eligible projects, public review requirements, denials, extensions, transfers. The availability of SPD Permits are part of a broader effort to facilitate Brownfields development in the Commonwealth, which will be the context for this discussion.
