MassCAIR (Clean Air Interstate Rule) 310 CMR 7.32

 

 


Ozone season NOx cap-and-trade program meeting EPA’s CAIR requirements. Covers all NOx budget program sources.


SIP submitted to EPA 3/30/07

Effective 5/4/07

Starts in 2009


EPA must approve.

Application forms will be on MassDEP website by July 1.

AIM and Consumer Products

310 CMR 7.25

Amendment to adopt 2001 OTC Model Rule for AIM and OTC 2001/2006 Model Rule requirements for CP.

Public hearings held in February, March.

Final rule in internal review.

Will be effective 1/1/09.

EPA will propose a national rule. 

 

 

Solvent Metal Degreasing

310 CMR 7.19(8)

(RACT category)

Include vapor pressure limitation for solvents used in cold cleaning consistent with 2001 OTC Model Rule.

Public hearings in late 2007.

 

Adhesives and Sealants -

primarily industrial and commercial use

New regulation to adopt 2006 OTC recommendation/Model Rule.

Public hearings in late 2007.

Industry does not object.

Dispensing of Motor Vehicle Fuel 310 CMR 7.24(6) - Stage II controls.

(Stage I is a RACT category)

Amend to require pressure vacuum (P/V) vent caps on vapor balance systems on underground storage tanks.

Public hearings as part of other Stage II revisions - summer 2007.

 

Asphalt Paving

310 CMR 7.19(9)

(RACT category)

Amend regulation to further reduce VOCs. OTC recommendation is complete ban on ozone season cutback use and reduced VOC content in emulsified asphalt.

CT public hearings held. Will follow progress in other states prior to MA proposal.  Stakeholder involvement will be needed.

Emulsion producers question VOC limits.

Portable Fuel Containers

Performance standards for gas cans.  Adopted in most OTC states already.

MassDEP not likely to do state rule.

EPA issued final national rule 2/07.
