Proposed Combined Heat & Power, Dry Cleaner & Stage II Amendments

N O T I C E

Notice is hereby given that the Department of Environmental Protection (MassDEP), acting in accordance with the provisions of M.G.L. Chapter 111, Sections 142A through 142N, will hold public hearings on proposed revisions to 310 CMR 7.00 et seq., Regulations for the Control of Air Pollution. The Commonwealth is committed to measures designed to attain and maintain national ambient air quality standards.  The proposed amendments are part of that commitment and will be proposed as a revision to the Massachusetts State Implementation Plan (SIP).

MassDEP is proposing revisions to its regulations for Stage II, the  Environmental Results Program (ERP) for perchloroethylene (perc) dry cleaning facilities (ERP-DC) and the requirements for stationary engines and combustion turbines for combined heat and power (CHP) projects.

The proposed revisions to the Stage II program seek to address certain sections of the regulations found to be unclear or at odds with efficient and effective facility compliance as well as a number of housekeeping measures updating applicable program requirements. The proposed amendments to the requirements for stationary engines and combustion turbines for CHP projects provide emission credits in recognition that CHP projects make more efficient use of the energy contained in the fuel, and consequently reduce greenhouse gas and other emissions as compared to separate systems. Finally, the proposed amendments to the ERP dry cleaning regulations incorporate the recent amendments to the federal Maximum Available Control Technology (MACT) standard (40 CFR Part 63, Subpart M) which will allow Massachusetts perc dry cleaners to comply with both federal and state requirements under one program (ERP-DC).
