Public Hearing Notice: Cape Wind Project Waterways Application

Notice of License Application pursuant to M. G. L. Chapter 91
Waterways License Application Number W08-2480

Applicant: Cape Wind Associates, 75 Arlington St., Boston, MA
Project Location: Yarmouth and Barnstable
Scheduled Public Hearing: November 5, 2008
Public Comments Deadline: November 24, 2008

NOTIFICATION DATE: October 22, 2008

Public notice is hereby given of the Waterways application by Cape Wind Associates to construct and maintain two submarine electric transmission cables and associated fiber optic cables within the municipalities of Barnstable and Yarmouth in Flowed Tidelands of Lewis Bay and Nantucket Sound. The cables are proposed to be located in the Cape & Islands Ocean Sanctuary. The proposed structures are associated with the Cape Wind Energy Project wind farm proposed in waters beyond the boundary of the Commonwealth. Please note that the wind turbines are not the subject of this license application and will not be specifically addressed at the hearing. The proposed project has been determined to be water-dependent. The applicant's representative is ESS Group, Inc, 888 Worcester St., Wellesley, MA.

The Department of Environmental Protection, Waterways Regulation Program, will conduct a public hearing on the aforesaid project proposal on:

Mattacheese Middle School
400 Higgins Crowell Road
West Yarmouth, MA

The Department will conduct this public hearing in order to receive information to be used in its decision on whether to grant a Waterways License pursuant to M.G.L. Chapter 91.

The Department will consider all written comments on this Waterways application received by November 24, 2008 (Public Comments Deadline). Failure of any aggrieved person or group of ten citizens or more to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c).
