NOTICE


PUBLIC NOTICE OF A DRAFT CLASS C HAZARDOUS WASTE RECYCLING PERMIT PURSUANT TO MASSACHUSETTS GENERAL LAW CHAPTER 21C AND MASSACHUSETTS HAZARDOUS WASTE REGULATIONS, 310 CMR 30.000.

PROPOSED:

Complete Recycling Solutions, LLC (CRS) is an existing hazardous waste recycling facility located at 1 Father DeValles Blvd, Fall River, MA, operating under the terms of a Hazardous Waste Recycling Permit #1RC/2004 issued by the Department of Environmental Protection ("Department") on June 7, 2004. The company proposes to relocate and continue its operation at 1075 Airport Road in Fall River, MA. There will be no changes to its present operation, capacity, waste handling activities or the conditions of its current permit. CRS has applied for a five-year permit from the Department to conduct recycling activities at 1075 Airport Road in Fall River, MA.

A Draft Permit has been issued by the Department. Pursuant to the public participation requirements in 310 CMR 30.200, the public has thirty (30) days to comment on the Draft Permit.

PUBLIC COMMENT:

Any member of the public wishing to comment on the Draft Permit may file written comments during the public comment period that will extend from January 17, 2008 to February 15, 2008. Comments should be submitted to:

A Fact Sheet that describes the permitting process, the company, its operation, and terms and conditions of the Draft Permit is available for review at the Fall River Board of Health, the Fall River Public Library, the Department's Lakeville and Boston Offices and on the MassDEP website at http://www.mass.gov/dep/recycle/hazardous/treatmen.htm. Anyone wishing to examine the Draft Permit may do so at these locations.

FINAL DECISION:

The Department will consider all written comments received during the comment period and the requirements of the Massachusetts Hazardous Waste Regulations, 310 CMR 30.000. The Department will then make a final decision regarding the issuance of a hazardous waste recycling permit to Complete Recycling Solutions, LLC. A notice of the final permit decision will be sent to the applicant and to each person who has submitted written comments, or has otherwise requested notice of the final permit decision. If no comments requesting a change in the Draft Permit are received, a final permit decision will become effective twenty-one (21) days after the date of the notice of the decision. The final permit decision will be postponed if a request for an adjudicatory hearing before the Department is made within the twenty-one (21) day period.
