Building Capacity for Managing Organic Materials

N O T I C E

Notice is hereby given that the Department of Environmental Protection, acting in accordance with the provisions of M.G.L. Chapter 111, Sections 142A through 142N; Chapter 111, Section 150A; Chapter 21, Sections 26 through 53; Chapter 21A, Sections 2, 13 and 16; and Chapter 21C will hold  public hearings on proposed amendments to 310 CMR 16.00, 310 CMR 19.000 and 314 CMR 12.00. 

The proposed changes to 310 CMR 16.00 include revisions to the exemptions from site assignment for recycling and composting activities; addition of permits by rule for operations that recycle, process, transfer or store recyclables or that compost or convert organic materials; a new permit for recycling, composting and conversion activities that do not qualify for a permit by rule; and general requirements for recycling, composting and conversion permits by rule and permits.

The proposed changes to 310 CMR 19.000 include only revisions to definitions that are also being revised in 310 CMR 16.00.

The proposed changes to 314 CMR 12.00 include explicitly allowing Publicly Owned Wastewater Treatment Works (POTWs) to accept source separated organic material at anaerobic digesters operated at wastewater treatment facilities with Department approval; adding new record keeping and reporting requirements regarding all source separated organic material accepted and processed in anaerobic digesters at POTWs; clarifying the existing requirement for Department approval of the O&M Manual; and including a presumptive approval process for rules and regulations, manuals, plans and contracts prepared by POTWs for Department review and approval.
