NOTICE

PUBLIC NOTICE OF MassDEP CORRECTIVE ACTION PROPOSED REMEDY DECISION IN ACCORDANCE WITH MASSACHUSETTS HAZARDOUS WASTE REGULATIONS 310 CMR 30.000 AND THE RESOURCE CONSERVATION & RECOVERY ACT (RCRA)

PROPOSED

Safety-Kleen Service Center (S-K or facility) is a hazardous waste storage facility operating under the terms of a Massachusetts Hazardous Waste Facility License.  In April 1999, S-K submitted a document titled Final Closure Report, Safety-Kleen Service Center, Bridgewater, MA to MassDEP.  This document was the equivalent of a Class A-2 Response Action Outcome (RAO) as specified in the Massachusetts Contingency Plan (MCP).  In response to MassDEP comments on the closure report S-K submitted correspondence titled Risk Evaluation, Safety-Kleen Corporation, 128 Elm Street, Bridgewater, MA dated August 3, 2009.  Specifically, S-K is proposing that a "Completion without Controls" determination has been achieved at the site. This is described more fully in the "Statement of Basis" document which is available for review at the locations provide below.  MassDEP has reviewed these documents and is hereby proposing that the remedy "Completion Without Controls" is appropriate for the facility.  S-K has terminated its hazardous waste storage activities at the site and intends to surrender its Hazardous Waste Facility License.

PUBLIC COMMENT

The public has thirty (30) days to comment on this decision to consider the corrective action complete at this facility.  Any member of the public may file written comments on the decision during the public comment period, which ends at 5 PM on September 11, 2009.  Comments should be submitted to:

A Statement of Basis describing the environmental conditions and corrective action for the facility is available at the Bridgewater Public Health Department, Bridgewater Public Library and MassDEP offices in Boston and Lakeville.  Anyone wishing to review this document may do so at these locations. MassDEP invites the public to comment on this corrective action remedy decision for the facility.  The proposed remedy decision, including public comment instructions, is described in detail in the Statement of Basis which is available at the locations listed above.

PUBLIC HEARING

MassDEP may schedule a public hearing on the proposed corrective action remedy decision if, during the comment period or within fifteen (15) days of the comment period, MassDEP receives written notice requesting an informal public hearing, or MassDEP determines on its own that there is significant public interest in this remedy decision.  Written and oral comments will be accepted at the hearing if held.

MassDEP FINAL DECISION

MassDEP will consider all written comments received during the comment period; all verbal and written comments received at a public hearing, if held.  A notice of the final decision will be sent to the applicant and to each person who has submitted written comments, or has otherwise requested notice of the final decision.  A final decision will become effective twenty-one (21) days after the date of the notice of the decision.  The final decision will be postponed if a request for an adjudicatory hearing before MassDEP is made within the twenty-one (21) day appeal period.
