Owners of Former Auto Salvage Yard and Junkyard in Springfield fined $32,500 by MassDEP

BOSTON - The Massachusetts Department of Environmental Protection (MassDEP) has fined Roy's Towing and Services, Inc., Roy's Towing Service, Inc., and George H. Roy, Jr., former operators and owner of the property at 876 Bay Street in Springfield, a total of $32,500 for failure to cleanup the Bay Street property.

Roy and his affiliated corporations owned and operated an auto salvage yard and junkyard at this location. Roy failed to undertake required cleanup actions in response to releases of diesel oil, waste oil, antifreeze, and gasoline that occurred from the late 1990s until early 2011. The releases were a result of improper car and truck crushing operations and from leaking drums. The City of Springfield recently foreclosed on the property for nonpayment of property taxes.

Previous attempts by MassDEP to resolve Roy's noncompliance through the issuance of verbal warnings, Notices of Noncompliance, Consent Agreements, and Orders have been largely unsuccessful. Mr. Roy has failed to take response actions to clean up the contaminated soils at his property and failed to submit documentation of any cleanup to MassDEP.

"The failure of Mr. Roy and his various affiliated entities to comply with the regulations over the years was ongoing and willful," said Michael Gorski, director of MassDEP's Western Regional Office in Springfield. "Despite repeated requests, notices, and orders by MassDEP, Mr. Roy failed on numerous occasions to undertake cleanup actions to address oil releases due to his car- and truck-crushing operations. It is essential that proper environmental cleanup occur to ensure releases do not result in threats to the public and further damage to the environment. The cleanup also provides opportunities for future economic development of this property and the surrounding community."


MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
