Oxford Property Owners Reach Settlement
to Address Solid Waste Program Violations

Two Oxford residents paid a $5,000 penalty to the Commonwealth of Massachusetts for violating state Solid Waste Management regulations.

During inspections conducted in March of 2008, Department of Environmental Protection (MassDEP) personnel noted the presence of a large pile of waste concrete on property located at 37-39 Federal Hill Road in Oxford, owned by Henry J. and Peter D. LaMountain. The owners did not have the permits or approvals required for the on-site disposal of these materials.
 
In a consent order signed with MassDEP, the LaMountains agreed to cease further on-site disposal of waste concrete on the property and removed the waste concrete observed on the property. The owners also disposed of that waste concrete at appropriate processing and disposal facilities in accordance with MassDEP requirements.

The LaMountains paid the $5,000 fine, and MassDEP suspended the remaining $22,070 of the assessed penalty as long as the owners do not have any further violations for one year.

"The cost of cleaning up improperly disposed of wastes is significantly higher than making the necessary arrangements for disposal at the time of generation," said Martin Suuberg, director of MassDEP's Central Regional Office in Worcester. "Property owners in this case worked with MassDEP to clean up the site expeditiously."


MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
