MassDEP Penalizes 89 Commercial Road LLC $9,000 for Solid Waste Violations in Leominster

A Leominster corporation, 89 Commercial Road, LLC, has been assessed $9,000 in penalties by the Massachusetts Department of Environmental Protection (MassDEP) for solid waste management violations that occurred at its 89 Commercial Road location.

During a May 2007 inspection, MassDEP personnel noted the presence of stockpiled crushed concrete at the Commercial Road property. The crushed concrete resulted from on-site building demolition and subsequent processing of the demolition debris. The corporation did not seek, and MassDEP did not issue, the permits or approvals necessary for on-site processing of these materials.

In a recently finalized consent order, 89 Commercial Road, LLC agreed to refrain from further on-site processing of concrete, to collect concrete samples for laboratory analysis, and handle the existing materials in accordance with MassDEP requirements. In addition, the company has agreed to pay $3,000 of the penalty, while MassDEP has agreed to suspend the remaining $6,000 pending compliance with the consent order.

"Property owners must refrain from the unauthorized disposal of solid wastes on parcels of land under their ownership," said Lee Dillard Adams, deputy director of MassDEP's Central Regional Office in Worcester. 


MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
