MassDEP Fines Seekonk Gasoline Station $2,000 For Violating State Environmental Regulations
The Massachusetts Department of Environmental Protection (MassDEP) assessed a $2,000 penalty against Stevens Sunoco of Seekonk for violating state hazardous waste regulations at its gasoline station and auto repair shop located at 1045 Fall River Avenue.
On December 5, 2008, approximately 120 gallons of waste oil from a ruptured aboveground storage tank (AST) was released at the site. A cleanup was performed, and then MassDEP conducted a preliminary inspection of the site. MassDEP observed that the waste oil AST stored outside did not have the required secondary containment. As a result, when the tank ruptured, the waste oil was released to the ground surface and adjacent vehicles at the station.
A follow-up inspection of the station and its records took place on December 8, 2008. The inspection indicated that Stevens Sunoco had sent hazardous waste for off-site disposal using an incorrect waste generator number. Also, the area utilized for waste accumulation hadn't been marked and the appropriate signage identifying the area was not posted. Five 55-gallon drums of waste oil were stored outside in unsecured areas and were not properly labeled or contained.
"The regulations regarding the management of hazardous wastes are very specific to ensure that these materials will have as limited an impact to the environment as necessary," said David Johnston, acting director of MassDEP's Southeast Regional Office in Lakeville. "It is vital that waste generators take responsibility and minimize any potential negative impact to the surrounding area."
As part of a negotiation settlement, Stevens Sunoco must correct all outstanding violations, submit an "On-Site Class A Recycling Notification Form" to MassDEP for the waste oil, and pay the penalty.
MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
