Stow Company To Pay $16,000 Penalty
for Violating Waste Site Cleanup Requirements

The Massachusetts Department of Environmental Protection (MassDEP) has penalized J. Melone & Sons, Inc. of Stow $16,000 for violating Waste Site Cleanup regulations connected to the company's property at 77 White Pond Road.

In May 2005, J. Melone & Sons had entered into a consent order with MassDEP for prior violations of the waste site cleanup regulations at its property. In the ensuing years, the company completed a portion of the required work, but failed to comply with a number of the deadlines, terms and conditions agreed to and contained in that order.

MassDEP and J. Melone & Sons have recently negotiated a second settlement agreement, which establishes new cleanup deadlines, and requires the payment of $16,000 in stipulated penalties contained in the original order.

"Violations of deadlines established and agreed upon by both parties for a cleanup can not be taken lightly," said Martin Suuberg, director of MassDEP's Central Regional Office in Worcester.

MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
