Charlton Company Penalized $30,348 For Hazardous Waste Management
And Toxics Use Reduction Act Violations

A manufacturer of fiber optic products located in Charlton, Incom, Inc. has been penalized $30,348 by the Massachusetts Department of Environmental Protection (MassDEP) for hazardous waste management and Toxics Use Reduction Act (TURA) violations that occurred at its 294 Southbridge Street location.

During a routine inspection by MassDEP, Incom was found to be treating hazardous waste by evaporation, accumulating hazardous waste in excess of applicable time limits, and failing to have complete hazardous waste training and contingency plans. In addition, the company failed to complete a TURA plan.

In a recently finalized consent order, the company agreed to maintain compliance with applicable regulations and pay a $22,400 penalty. The remaining penalty ($7,948) will be suspended, pending the successful implementation of an Environmental Management System, which will be designed to put procedures in place to minimize the potential for future violations of environmental regulations.   

"As this company grew, the characteristics of its wastewater changed from non-hazardous to hazardous waste, but failed to have the appropriate licenses or approvals for treating hazardous waste, drawing a substantial penalty," said Lee Dillard Adams, deputy director of MassDEP's Central Regional Office in Worcester. 


MassDEP is responsible for ensuring clean air and water, safe management and recycling of solid and hazardous wastes, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources.
