National Hazardous Waste Manifest Form

As of September 5, 2006, all Massachusetts generators and Treatment, Storage and Disposal Facilities initiating shipments of hazardous waste and waste oil must use the new national six-part manifest form required by the U.S. Environmental Protection Agency (U.S. EPA).
 
OLD MASSACHUSETTS 2-, 4- OR 8-PART FORMS CAN NO LONGER BE USED FOR ANY SHIPMENTS.

The Massachusetts Department of Environmental Protection (MassDEP) adopted new regulations regarding the use of this form.  These regulations went into effect on June 29, 2007, and are posted at: www.mass.gov/dep/recycle/laws/regulati.htm#hw

Manifest Forms

Forms can be ordered from U.S. EPA-approved and registered printers.  See the vendor list at: www.epa.gov/epaoswer/hazwaste/gener/manifest/registry/printers.htm

Complete and distribute forms according to the instructions on the new manifest and continue to use the appropriate waste codes, including those for wastes that are regulated only by Massachusetts (e.g. MA01 for waste oil). 

Commonly Asked Questions

Do Massachusetts Generators Have to Send a Manifest Copy to MassDEP?

If the hazardous waste shipment goes directly to a Massachusetts hazardous waste facility, the generator does not have to submit a copy to MassDEP.  If the shipment goes directly to an out-of-state hazardous waste facility, the generator must submit a fully executed photocopy of Copy 3 to MassDEP within 30 days of receiving it from the designated facility.  

How many copies of the manifest must a generator use for intrastate shipments of waste oil?

Only five of the six copies need to be distributed, as required by 310 CMR 30.315.

How many copies of the manifest must a Very Small Quantity Generator use for intrastate shipments?

Only five of the six copies need to be distributed, as required by 310 CMR 30.315.

What manifest copy distribution requirements apply to generators of hazardous wastes that are subject to a contractual agreement (e.g. spent solvent from a parts cleaner)?

Only two copies of the six-part manifest need to be distributed: one copy retained by generator and one by facility. See 310 CMR 30.314.

Electronic Monthly Operating Reports (EMORs)  

The rules requiring transporters to submit EMORs (310 CMR 30.407) have not changed, but MassDEP will provide a new electronic template for these reports that reflect the new national manifest form in late 2007. Updates on the availability of the new template will be posted on this web page.
