Wetlands Protection Act: Instructions for eDEP Online Filing
Notice of Intent (NOI), Abbreviated Notice of Resource Area Delineation (ANRAD), Order of Conditions (OOC), and Order of Resource Area Delineation (ORAD)
Instructions to WPA Form 3 - Notice of Intent (NOI) and WPA Form 4A - Abbreviated Notice of Resource Area Delineation (ANRAD):
Users include Applicants and Consultants.
1. Create A New User Account on the Main Page. Follow the prompts in Step 1 of 2: Create Your Account. Fill out all of the personal information to create your account profile. At the end, accept the Terms and Conditions and click NEXT. (Remember your username and password, because you only need to create your account once!)
2. Step 2 of 2: How will you use eDEP? Do any items listed on this page describe you or how you will use eDEP?
If you are filing a NOI or ANRAD for someone else, click YES, then click NEXT. You will be required to fill out a Proof of Identity form to submit your form. Please see instructions for the Proof of Identity below.
If you are filing a NOI or ANRAD for yourself, click NO, then click NEXT. Click on MY HOMEPAGE to begin using eDEP.
Note: If you are an Applicant or Consultant filing an NOI or ANRAD on your own behalf or on the behalf of a client, you do not need to complete a Proof of Identity, but you may want to; especially if you submit a lot of filings in different DEP Programs or if you want to oversee filings submitted by your employees. This will get you access to more eDEP forms and functions.
3. Pick your form (WPA Form 3 - NOI, or WPA Form 4A - ANRAD) in the top dropdown menu.
4. In Step 1 of 3, you will Complete, Save and Validate your form and sub-forms related to this transaction. More detailed form instructions can be found here: Web page.
5. In Step 2, you'll provide an Acceptance of your form via signature(s) of your applicant, owner, and/or representative.
6. And lastly, in Step 3, you'll electronically Submit your form to the Mass DEP. In return, you'll get a Summary & Receipt. Mail your plans, hydrologic calculations or other supporting materials to the appropriate DEP Regional Office. Please make sure you write your DEP Transaction ID on all materials so that DEP can match them up with your online submission. Payments for the state portion of your fee should be made payable to the Commonwealth of Massachusetts, and mailed to DEP, Box 4062, Boston, MA 02211.
Instructions to WPA Form 5 - Order of Conditions (OOC) and WPA Form 4B - Order of Resource Area Delineation (ORAD):
Users are Conservation Commissioners, Conservation Agents, Administrators and Municipal Employees.
1. Create A New User Account on the Main Page. Follow the prompts in Step 1 of 2: Create Your Account. Fill out all of the personal information to create your account profile. At the end, accept the Terms and Conditions and click NEXT.
2. Step 2 of 2: How will you use eDEP? Do any items listed on this page describe you or how you will use eDEP?
If you a Conservation Commissioner/Agent preparing an OOC/ORAD, click YES, then click NEXT. You will be required to fill out a Proof of Identity form to submit your form. Please follow the instructions for the Proof of Identity below.
Note: It takes about one week for a Proof of Identity to be processed. You can fill out your form and save it at anytime, however, you will not be able to Submit it until you are notified by email that your Proof of Identity has been processed. Once you have received your notification from DEP, login and go to My Homepage and select the form you wish to complete and submit.
3. Pick your form (WPA Form 5 - OOC, or WPA Form 4B - ORAD) in the dropdown menu (it will be the bottom dropdown menu if your Proof of Identity has not yet been processed).
4. Enter a valid NOI File number in the pre-form, and click SEARCH. Check off the box below and NEXT, if this is the correct file. If you need to search to see if a File number has been issued, please go to:

5. In Step 1 of 3, you will Complete, Save and Validate your form and sub-forms related to this transaction. You will be able to override any auto-filled data on the form (this is the data that currently resides in the Department?s database).
6. In Step 2, you'll provide an Acceptance of your form via signature(s) of your Conservation Commission members. Please have the same number of Commissioners sign below as you indicated in the Order submittal (under Section E in the OOC, or Section F in the ORAD).
7. And lastly, in Step 3, you will electronically Submit your form to the Mass DEP. In return, you'll get a Summary & Receipt. This electronic submission is considered the Department's copy of the Order. The Order must still be mailed by certified mail (return receipt requested) or hand delivered to the applicant.
Proof of Identity
Introduction
Administrator: A person who oversees or coordinates filings or submittals for an organization, business or municipality. An Administrator must submit a notarized Proof of Identity. After receiving an Administrator Proof from DEP, you can designate others who will be submitting NOIs, ANRADs, OOCs, or ORADs on your behalf or on the behalf of your company or organization. For example, the Administrator for a Conservation Commission might be the Conservation Agent or the Planning Director. The Administrator for a consulting firm might be a senior manager or the president. The Administrator can designate others to make filings through eDEP and will automatically be notified via email whenever a filing is made for their company or organization.
Conservation Commissioners and their staffs may register as individuals or may choose to have a commission member or the staff person serve as an Administrator. If you do not choose to have an Administrator, each commissioner and staff member who wish to submit OOCs/ORADs through eDEP will have to submit the Proof of Identity form.
If a business or Conservation Commission has chosen to designate an Administrator, the person serving as the Administrator will have to submit a notarized Proof of Identity; while other users (employees, commissioners) will need to give the Administrator their "aliases" that are established when they register to use eDEP. The Administrator will use your alias to allow you to use eDEP on behalf of your organization or municipality.
Instructions to Completing the Standard Proof of Identity Form
1. Conservation Commissioners and their staff are required to complete the Standard Proof of Identity Form in order to use eDEP. Complete Section B.
2. If you are a Conservation Commissioner or staff, fill out Item #7 on the second page with the name of your town and the expiration of your term, if applicable.
3. Print out the form. If you want to be an Administrator, complete Section C and have it notarized.
4. ALL Proof of Identity Forms must be signed by hand (second page).
5. Make a copy of the form and mail the original to:
