Glossary Of Enforcement Terms ACO - Administrative Consent Order an administrative enforcement order agreed to by all parties, not subject to appeal.
ACOP - Administrative Consent Order with Penalty an administrative enforcement order agreed to by all parties, not subject to appeal.
Consent Decree - a judicial enforcement order agreed to by all parties, which may or may not include a penalty, not subject to appeal.
NON - Notice of Noncompliance - the first level of enforcement action, which generally describes the violation, the steps needed to return to compliance, and a schedule for doing so. NONs do not include a penalty and cannot be appealed.
UAO Unilateral Administrative Order - an enforcement order issued by DEP without agreement of the alleged violator, which may or may not include a penalty. UAOs may be appealed. |
