Storm water program regulations proposed under 310 CMR 21.00 are undergoing revision following the extensive comments received during the public hearing process. The proposed addition of associated storm water fee categories in 310 CMR 4.00 and included in the DEP Fees and Program Improvements Package 2009-2 are being withdrawn from promulgation pending new public hearings on the underlying program regulations.

310 CMR 6.00 & 310 CMR 7.00 et. seq.: Proposed Amendments to Massachusetts Ambient Air Quality Standards - July 2009
In July 2009, MassDEP proposed revisions to 310 CMR 6.00 that would have made the Massachusetts air quality standards for particulate matter and ozone consistent with the National Ambient Air Quality Standards (NAAQS) adopted by the U.S. Environmental Protection Agency (EPA). Because EPA is planning to issue revised NAAQS for particulate matter and ozone in 2011, MassDEP has decided not to proceed with revisions to 310 CMR 6.00 until EPA promulgates the new final NAAQS for these pollutants.

310 CMR 7.00 et. seq.: Proposed Opacity Amendments - August 2005
These amendments would exempt five compounds from the definition of Volatile Organic Compounds (VOCs) for consistency with federal rules, impose visible emission limits on certain facilities that are required to have Operating Permits, and expand the time period during which gasoline tank trucks are required to be tested for vapor leak tightness. Public hearings are scheduled for October 18, 2005, in Boston and October 19, 2005, in Springfield.

These proposed regulations would require dentists to install and properly operate amalgam separators and recycle their mercury-containing amalgam wastes, August 2005. Public hearings will be held during the week of October 3, 2005. The public comment period closed on October 28, 2005.
