Request for Determination of Applicability (BRP WW 04) This determination is intended to answer with certainty whether a Waterways license or other authorization is required. For Wetlands Protection Act jurisdiction, use WPA Form 1, below. Revised September 2006. Chapter 91 Waterways License, Permits, Amendments (BRP WW 01, BRP WW 03, BRP WW 14, BRP WW 15, BRP WW 16, BRP WW 17) For both water-dependent and non-water-dependent projects, including small residential docks, piers, Municipal Harbor Plans, dredging, and more. Revised June 2006. More ... Chapter 91 Simplified License and License Renewal (BRP WW 06, BRP WW 12) This license is intended to streamline the licensing process for owners of small residential docks, piers, seawalls and bulkheads. Simplified licenses have a limited term of 10-15 years. More... Certificate of Compliance (BRP WW 05) The Certificate of Compliance confirms that a project licensed under Chapter 91 has been completed according to the conditions of that license. Water Quality Certifications
BRP WW 07, 08, 09: Water Quality Certifications, Dredging Projects This permit is required for dredging projects which must obtain federal licenses and would result in a discharge to state waters. Revised September 2001. BRP WW 10, 11: Major/Minor Fill and Excavation Projects This permit is required for projects that impact wetlands and submerged land, rare species, salt marshes, or other conditions as detailed in the Instructions. Wetlands Protection Act Permits
Notary Block No Longer Required for Wetlands Permits In order to improve program efficiencies, MassDEP has determined that a Notary Acknowledgement is not required for recording Wetland Protection Act (WPA) forms. As such, the WPA forms have been revised and will no longer require a Notary Acknowledgement prior to recordation. The Registries of Deeds were notified of this program policy change in this correspondence, dated February 26, 2010. WPA Form 1: Request for Determination of Applicability This process enables the applicant to seek a determination of whether the provisions of the Wetlands Protection Act apply to a particular land area, determine the boundaries of a wetland resource area, or other circumstances under which proposed work would be regulated by the Act. For projects governed under Chapter 91 (Waterways) regulations, see above. Revised May 2006. WPA Form 2: Determination of Applicability This form is for use by Conservation Commissions in response to a Request for Determination of Applicability (WPA Form 1). Revised October 2004. WPA Form 3: Notice of Intent The Wetlands Protection Act prohibits the removal, dredging, filling, or altering of wetlands without a permit. A Notice of Intent is required to obtain such a permit. WPA Form 4: Abbreviated Notice of Intent This form simplifies filing requirements for projects which are likey to result in limited impacts to wetland resource areas. Revised April 2006. WPA Form 4A: Abbreviated Notice of Resource Area Delineation This form provides a procedure for an applicant to confirm the delineation of a bordering vegetated wetland. WPA Form 4B: Order of Resource Area Delineation This form is for use by Conservation Commissions in response to a request for resource area delineation. The form has been revised in accordance with changes in the Wetlands Regulations, 310 CMR 10.00, relative to Simplified Review for Buffer Zones and to stormwater. A minor revision in 2009 modified the format for recording latitude and longitude data. Revised December 2009. WPA Form 5: Order of Conditions Form 5 has been revised in accordance with changes in the Wetlands Regulations, 310 CMR 10.00, relative to Simplified Review for Buffer Zones and to stormwater. Format modifications have been made to accommodate requirements of the Registries of Deeds. Revised May 2010 (added note about Registries formatting on first page). WPA Form 6: Notice of Non-Significance This form is for use by Conservation Commissions to signify that proposed work will not significantly impact a wetland resource area. Revised March 2010 (notary acknowledgement deleted). WPA Form 7: Extension Permit for Order of Conditions This form is for use by Conservation Commissions to authorize the extension of a previously issued Order of Conditions, for no more than three years. Revised March 2010 (notary acknowledgement deleted). WPA Form 8A: Request for Certificate of Compliance Upon completion of work authorized in an Order of Conditions, the property owner must request a Certificate of Compliance from the issuing authority (MassDEP or the Conservation Commission) stating that the work has been satisfactorily completed. Revised July 2004. WPA Form 8B: Certificate of Compliance This form is for use by Conservation Commissions in response to a Request for Certificate of Compliance. Format modifications have been made to accommodate the requirements of Registries of Deeds. Revised December 2009. WPA Form 9: Enforcement Order This form is for use by Conservation Commissions when an activity has been identified that is in violation of the Wetlands Protection Act. Revised July 2004.
