321 CMR 10.04: Public Health and Rare Species Regulations

In accordance with the Massachusetts General Laws, Chapter 131A, Section 4, and Chapter 30A, Section 2, NOTICE is hereby given of a public hearing to be held on Tuesday, April 22, 2008, at 3:00 P.M. at the Division of Fisheries & Wildlife Field Headquarters, 1 Rabbit Hill Road, Westborough, Mass., to establish rules and regulations relative to declaration of a public health hazard by the Commissioner of Public Health in areas occupied by state-listed rare species. Plain Language Summary of Hearing Proposal:

The change addresses the taking of state-listed endangered, threatened, or special concern species in order to protect public health, and would remove the requirement that the Governor declare a public health emergency and substitute the requirement that the Commissioner of Public Health declare that a public health hazard exists. This change was implemented last year as an emergency regulation, and would now be promulgated as a formal regulation.
