Ladies & Gentlemen:

The Division of Marine Fisheries has determined that shellfish, except for Ocean quahogs (Arctica islandica) whole Sea scallops (Placopecten magellanicus) in the shell or roe-on, and carnivorous snails, channeled and knobbed whelks, and moon snails (Lunatia heros) and (Polinices duplicatus), from the below-defined area no longer contains biotoxins (PSP) from the phytoplankton Alexandrium (spp) in excess of established standards.

Therefore, under authority of Massachusetts General Laws, Chapter 130, Section 74A, 75 and 322 CMR 7.01 (7) at sunrise on August 19, 2005, the PSP closure of May 20, 2005 will be amended as follows in the below-defined area. This area is classified as PROHIBITED and in the “closed” status to shellfish harvesting for direct human consumption. Digging, harvesting or collecting and/or attempting to dig, harvest or collect shellfish and the possession of shellfish from the below defined area is prohibited except for the harvest of Surf clams (Spisula solidissima) for bait purposes only.
