Ladies & Gentlemen:
The Division of Marine Fisheries has determined that the carnivorous snails known as Waved whelks (Buccinum undatum), Stimpson’s whelks (Colus stimpsoni), and Ten-ridged whelks (Neptunea decemcostata) no longer contain biotoxins (PSP) from the phytoplankton Alexandrium (spp.) in excess of established standards. Closures remain effect for carnivorous Moon snails (Polinices duplicatus and Lunatia heros)
Therefore, under authority of Massachusetts General Laws, Chapter 130, Section 74A, 75 and 322 CMR 7.01 (7) at sunrise on November 10, 2006 the below-defined portions of Massachusetts Bay will revert to their former status prior to the PSP closures of May 26, 2005 for the harvest of Waved whelk (Buccinum undatum), Stimpson’s whelk (Colus stimpsoni), and Ten-ridged whelk (Neptunea decemcostata) for direct human consumption subject to local rules and regulations under authority of Massachusetts General Laws Chapter 130, section 52.

“The waters, flats and all tributaries southerly of a line drawn southeasterly along the Gloucester/Manchester–By-The-Sea town line and extending southeasterly to the Massachusetts Territorial Waters line, including a portion of growing area MB:14; east of a line drawn from the southern tip of Deer Island in the Town of Winthrop to the tip of Point Allerton in the Town of Hull; northerly of a line drawn directly east from the tip of Point Allerton to the Massachusetts Territorial Waters line, including portions of growing areas MB:9 and MB:14.
