To the selectmen of the following municipalities:
Hull, Cohasset, Scituate, Marshfield, Duxbury, Plymouth, Bourne and Sandwich
Ladies & Gentlemen:
Due to Paralytic Shellfish Poison ( PSP ) toxin (also known as “Red Tide”) in shellfish and reported elevated phytoplankton levels of the dinoflagellate Alexandrium (spp.), the Division of Marine Fisheries has closed the below-defined areas.
Therefore, under authority of Massachusetts General Laws, Chapter 130, Section 74A and 75, the status of the below-defined areas has been changed to CLOSED TO THE TAKING OF BIVALVE SHELLFISH AND CARNIVEROUS SNAILS, WITH THE EXCEPTION OF THE ADDUCTOR OF THE SEA SCALLOPeffective immediately. Digging, harvesting or collecting and/or attempting to dig, harvest or collect shellfish and the possession of shellfish, including carnivorous snails, from the below-defined areas is prohibited.
Under authority of 322 CMR 7.01(7) all permits issued thereunder are hereby conditioned to prohibit the taking, selling or possession of shellfish from the below-defined areas.
AREA CLOSED TO THE HARVEST OF ALL BI-VALVE SHELLFISH AND CARNIVEROUS SNAILS with the exception of the sea scallop adductor muscle
"The waters and flats of the Commonwealth in the above-listed cities and towns south of a line drawn from Point Allerton in the Town of Hull easterly to the state territorial waters line; southward to the Bourne/Sandwich town line including areas MB:1 through MB:12 and CCB:38 to CCB:41, CCB:48 and CCB:51.
Excluded from this closure is the Plymouth/Kingston/Duxbury Bay complex; areas CCB:42 through CCB:47 which remain open to the harvesting of all shellfish. All previous bacterial closures in areas CCB:42 through CCB:47 remain in full force and effect.”
