The Division of Marine Fisheries has determined that shellfish from the below-defined areas (OC:3 in its entirety and part of OC:2) in the Town of Orleans no longer contain biotoxins ( (Paralytic Shellfish Poison-(PSP))from the phytoplankton Alexandrium (spp.) in excess of established standards.

Therefore, under authority of Massachusetts General Laws, Chapter 130, sections 74A and 75 and 322 CMR sections 7.01 (7), 7.02 and 10.00, the PSP closures of April 11, 2008 will be rescinded at sunrise on April 16 in the below-defined areas. Shellfish in areas currently classified as APPROVED and in the “open” status may now be harvestedfor direct human consumption subject to local rules and regulations under authority of Massachusetts General Laws Chapter 130, section 52. Similarly, those areas classified as CONDTIONALLY APPROVED and in the “open” status are subject to the classification conditions. Therefore, under authority of Massachusetts General Laws, Chapter 130, Section 74A and 75, the status of the below-defined areas have been changed to "OPEN TO SHELLFISHING".

Nauset Marsh System South (OC:3 and a portion of OC:2)

“The area south of a line drawn east from the northern tip of Weeset Point (at the end of Tonset Road) in the Town of Orleans to the Eastham-Orleans town boundary marker located on the northern-most tip of Tern Island in the Town of Orleans and continuing east to Nauset Beach.”
