Alternative Compliance Payment

Any retail electricity supplier that is required by the MA RPS regulations to comply with those regulations may, if necessary, choose to discharge some or all of its obligations by making an Alternative Compliance Payment (ACP) in the appropriate amount to the Massachusetts Technology Park Corporation (a.k.a. Mass Technology Collaborative, or MTC). See 225 CMR 14.08(3) and 14.09(2)(e).

The ACP rate for the 2007 RPS Compliance Year is $57.12 per MWh. The MTC will provide a receipt for each ACP payment, and copies such receipts would be included by the retail electricity supplier with its Annual Compliance Filing. Filings for the 2007 Compliance Year must be submitted to DOER no later than Tuesday, July 1, 2008.

Compliance Year 2008 ACP Rate Adjustment

Pursuant to the Regulations for the Massachusetts Renewable Energy Portfolio Standard (MA RPS), the adjusted rate for Alternative Compliance Payments (ACPs) for each Compliance Year must be published by January 31 of that Compliance Year. See 225 CMR 14.08(4)(a)2.

Accordingly, the Massachusetts Division of Energy Resources (DOER) hereby announces that the adjusted rate for MA RPS Alternative Compliance Payments for the 2008 Compliance Year has been determined to be $58.58 per MWh (formal announcement of the adjusted rate for 2008).
