Instructions and Forms for the 2006 Annual Compliance Filing for Compliance Year 2006 by Retail Electric Suppliers


The RPS Regulations at 225 CMR 14.07(1) require that each Massachusetts Retail Electricity Supplier include in its total annual sales of each Massachusetts Retail Electricity Product a minimum percentage of electrical energy sales with New Renewable Generation Attributes. The minimum percentage for 2006 is two and a half percent (2.5%). (It will be 3.0% for 2007.)

The RPS Regulations 225 CMR 14.09(1) require that, in order to demonstrate compliance with that requirement, each Retail Electricity Supplier must submit to DOER an Annual Compliance Filing no later than the first day of July of the subsequent Compliance Year. The Annual Compliance Filing for Compliance Year 2006 is due by Monday, July 2, 2007.

The final instructions and forms for the Annual Compliance Filing for Compliance Year 2006 PDF were sent by e-mail on June 8 and June 11 to companies identified by DOER as definitely or possibly serving retail load in Massachusetts in 2006.

If your company served retail load in Massachusetts and you did not receive a copy of the forms (including the spreadsheet version of Table One) directly from DOER by email, then please request them immediately. Additional filing instructions will also be provided with the spreadsheet.

DOER has made hardly any changes for 2006 as compared to 2005. However, Annual Compliance filers are still advised to begin by carefully reading all instructions and reviewing all forms.

Note that Alternative Compliance Payments, if needed for 2006 compliance, must be submitted by wire transfer to the Massachusetts Technology Collaborative no later than June 26, 2006, per the instructions.
