TLA-Holbrook LLC has proposed a 1,000 ton per day truck and rail haul municipal solid waste transfer station for a 14.85-acre area of industrial park land at 3 and 6 Phillips Road, Holbrook. The 3 Phillips Road property is owned by the Town of Holbrook and leased to TLA-Holbrook LLC. Part of the 3 Phillips Road property is a former chemical plant and is a state-listed Tier 2 disposal site assigned MassDEP Release Tracking Number (RTN) 4-3024519. The Tier 2 disposal site will be remediated under the Massachusetts Contingency Plan (MCP) 310 CMR 40.0000 as part of the redevelopment of the Site for the proposed solid waste handling facility. In January 2013, the Massachusetts Environmental Policy Act (MEPA) Office determined that an Environmental Impact Report (EIR) was not required for the proposed solid waste handling facility.

Before it can proceed with its plans, TLA-Holbrook LLC needs to obtain three sequential approvals from the Department of Environmental Protection (MassDEP): 

  • Site Suitability Determination
  • Authorization to Construct Permit
  • Transfer Station Certification (30 days before commencing operations)

2017 TLA-Holbrook LLC Proposal

On April 25, 2017, TLA-Holbrook LLC submitted correspondence withdrawing its June 18, 2014, Site Suitability Application and submitted a new application with a revised facility design. Upon review of the information, MassDEP on May 18, 2017, issued a Notice of Administrative Completeness, requiring public notice and a public comment period on the new application. MassDEP held a 21-day public comment period, which ended on July 3, 2017. TLA Holbrook LLC responded to comments on July 24 and 27, 2017. 

On August 11, 2017, MassDEP completed its review of the application, public comments, and the response to comments, and made its determination of site suitability under the authority of M.G.L. c.111, ss.150A and 150A½, as amended, and 310 CMR 16.00. The proponent has submitted sufficient information for MassDEP to determine that the Site meets all applicable suitability criteria for the proposed use.

The Holbrook Board of Health has published notice and will hold a public hearing for the purpose of deciding whether to grant or refuse to grant a site assignment for the parcels of property proposed by TLA Holbrook LLC to be site assigned. The public hearing is scheduled for:

Withdrawn 2014 TLA-Holbrook LLC Permit Application

On June 18, 2014, TLA-Holbrook LLC submitted a permit application containing a Site Suitability Report for a New Site Assignment to the MassDEP Southeast Regional Office, which subsequently reviewed the submittal and issued a Determination of Administrative Incompleteness, requesting additional information. 

TLA-Holbrook LLC provided supplemental information and on May 21, 2015, MassDEP issued a Determination of Administrative Completeness. The agency conducted a 21-day public comment period on the proposal, which ended on July 20, 2015. 

MassDEP issued a Negative Report on Site Suitability to the proponents and the Holbrook Board of Health on September 10, 2015. Two weeks later, on September 24, 2015, TLA-Holbrook filed motions for MassDEP to reconsider its Negative Report and reopen the public record. On October 9, 2015, MassDEP issued a response to the company's motions and reopened the public record. 

On January 29, 2016, MassDEP issued a second Negative Report on Suitability. On February 12, 2016, TLA-Holbrook filed a second motion for reconsideration. On April 25, 2017, TLA-Holbrook filed a motion to withdraw the original application and file a new application with a revised facility design.
