Classification of contaminated sites are required if a Response Action Outcome (RAO) Statement or a Downgradient Property Status has not been submitted within a year of notification.
The Tier Classification process consists of:
- a complete Phase I report in accordance with 310 CMR 40.0480;
- completion of a Numerical Ranking System Scoresheet in accordance with 310 CMR 40.1500;
- a comparison of conditions at a disposal site with the Tier I Inclusionary Criteria set forth in 310 CMR 40.0520; and
- the preparation and filing with the Department of a Tier I or Tier II Classification submittal in accordance with 310 CMR 40.0510(2).
The permit process helps determine and document the severity and complexity of the site, and the needed degree of MassDEP oversight.
