The Indian Child Welfare Act has been in effect since 1978, and was enacted by Congress to protect the best interests of Native American Children and to promote stability and security of federally recognized Native American tribes.

Under ICWA, standards are set for the placement of Indian children in foster or adoptive homes and for the prevention of the breakup of Indian families.
The Indian tribe must be notified immediately if a child who is determined to be an Indian Child is placed in the custody of the Department of Children and Families through court action.
