Governor Patrick re-established the Commission In November 2008 through Executive Order 507. In March 2010, Governor Patrick issued Executive Order 521, renaming the Governor's Commission on Mental Retardation to be the Governor's Commission on Intellectual Disability.

The Commission is an independent citizen oversight body consisting of 11- 13 members appointed by the Governor for a term of three years.
