The hospital licensure regulation (105 CMR 130.365) requires hospitals that offers a separate, identifiable substance abuse treatment inpatient or outpatient program for persons with substance use disorders to comply with the requirements set forth in 105 CMR 164.000, Licensure of Substance Abuse Treatment Programs.
Hospitals licensed under M.G.L. C. 111, § 51 that wish to add or expand a substance use treatment program must coordinate with the Division of Health Care Facility Licensure and Certification for plan review as applicable, and to add a service to their hospital license, and contact the Bureau of Substance Abuse Services for application information and approval:
No hospital may offer a substance abuse treatment program unless the Department’s Bureau of Substance Abuse Services has issued an approval for such program.
