At its July 14, 2009 Public Meeting, the Board of Building Regulations and Standards (BBRS) voted two clarification amendments to Appendix 120.G.


Appendix 120.G sets certain construction requirements for buildings and structures erected in areas prone to flooding and in areas containing coastal dunes.

Appendix 120.G requirements address critical life-safety concerns relating to building in areas prone to flooding and also are intended to be consistent with criteria of the National Flood Insurance Program (NFIP).

In areas prone to flooding, requirements of Appendix 120.G preclude the construction of Residential Use building basements and cellars below the base flood elevation (BFE).

It has come to the attention of this office that certain language of Appendix 120.G of the 7 th Edition Building Code is written in such a way that interpretation of such is leading to the designing and constructing of buildings and where the basements are being set below the Base Flood Elevation (BFE) in violation of Code intent and FEMA/National Flood Insurance Program (NFIP) intent.
