The Department of Public Safety and the Division of Occupational Safety have filed an emergency amendment to its regulation which extends the deadline for municipalities and state public agencies to implement the Trench Regulation (520 CMR 14) to March 1, 2009.  In November 2007, the DPS and DOS promulgated regulations which require public agencies and municipalities to appoint a permitting authority to issue permits for trenches which are dug on land owned by that state agency. The implementation date was delayed for a year, until January 1, 2009, in order to give the state agencies and cities and towns the necessary time to set up this permitting process. While many municipalities have appointed a permitting authority, the Department and DOS are working with the Massachusetts Municipal Association to ensure that the remaining municipalities are in full compliance with the March 1 st deadline.
