The Department of Public Safety ("Department") is pleased to announce the completion of draft amendments to regulations governing the operation of Hoisting Equipment as included at 520 CMR 6.00. The Department held a public hearing on April 24, 2007 to receive testimony and comments on proposed changes to the regulation and received comments at that time. Due to this response, the Department further revised the proposed regulations, and will hold a second public hearing on March 6, 2008, at 10:00 AM, One Ashburton Place 21th Floor.

During the course of the drafting process, the hoisting regulations have undergone a significant overhaul. The intent of the amendments is to increase the safety of those individuals operating hoisting equipment, working in the vicinity of hoisting equipment, and the public at large. Several draft regulation sections are brand new. These include a new continuing education section that specifies the requirements to become a Department-approved training program offering continuing education courses. The Department is also introducing a section on apprentice licenses and apprentice license training programs. The apprentice license training programs will enable individuals applying for a license to operate hoisting equipment to receive hands-on training prior to licensure while under the direct supervision of a duly-licensed instructor.

Other additions include a new section pertaining to public utility companies that mirrors General Law, chapter 146, §53. In addition, new general administrative sections have been added. Highlights include new accident reporting and investigation requirements and the clarification of language related to the licensure appeal process. Finally, proposed changes include the elimination of the section related to short-term rentals of hoisting equipment by unlicensed operators. The operation of hoisting equipment by unlicensed, casual operators with minimal, if any, training is a significant public safety concern.
