How Chapter 385 Affects Schools and Taxi Cab Companies
Chapter 385 of the Acts of 2002 amended M.G.L. c.71, §38R to require schools to screen current and otherwise qualified prospective employees and volunteers, who may have direct and unmonitored contact with children, for all available Criminal Offender Record Information (CORI), including individuals providing transportation. This must be done every 3 years. Chapter 385 also authorizes schools to run CORI checks on subcontractors and laborers commissioned by the school to perform work on school grounds.
Additionally, Chapter 385 of the Acts of 2002 amended M.G.L. c. 6 by adding §172I which mandates schools to obtain all CORI for employees of taxicab companies who are contracted to provide transportation of children, prior to transporting any child. Taxicab companies must provide, to the school, the names and dates of birth of employees who may have direct and unmonitored contact with children.
