Gonzalez Indicted For Willfully Misleading A Person In Furtherance Of A Continuing Investigation And Parental Kidnapping

Ernesto Gonzalez, 36, of Lynn, was indicted this afternoon by an Essex County Grand Jury on charges of willfully misleading a person in the furtherance of a continuing investigation and parental kidnapping.

The first indictment carries a maximum penalty of 10 years in state prison. Parental kidnapping carries a maximum sentence of one year in the House of Correction.

Gonzalez will be arraigned in Salem Superior Court at 9:30 tomorrow morning.

A pending charge of child endangerment in Lynn District Court will be dismissed after he is arraigned in Superior Court.

Gonzalez is the father of 5 year-old Giovanni Gonzalez, who was last seen with his father on Saturday, August 16, 2008.

Police have conducted an extensive search and investigation into the case of this missing child. Gonzalez has denied ever having custody of Giovanni on the weekend the little boy disappeared. But investigators have determined that Giovanni was seen with his father by witnesses on that Saturday.

The District Attorney is precluded from commenting about this case outside of the courtroom pending the completion of this ongoing investigation.
