Marblehead Man Sentenced for Rape of a Child
Lawrence Superior Court Judge Richard Welch today sentenced John Murphy, 24, of Marblehead, to 9-11 years in state prison for raping a 14 year old Marblehead girl 2 ½ years ago.
Essex Assistant District Attorney Karen Hopwood had asked that the defendant be sentenced to 12-14 years in state prison, while Defense Attorney Alexander Cain had requested a term of 4-7 years.
Murphy had been convicted by a jury of two counts of rape of a child and two counts of furnishing alcohol to a minor on November 17, 2011. The jury deliberated for about three hours before returning its verdict, following the four day trial.
Prosecutor Hopwood proved that on June 12, 2009, Murphy took the victim and three other 14 year old girls back to a residence where he was housesitting. Murphy provided alcohol to the victim and one of the other girls. The victim had also taken some Klonopin.
The victim became very intoxicated, and subsequently Murphy and the girls went to Marblehead’s Crocker Park, where the rapes took place.
Upon his release from prison Murphy will be on probation for five years and will be on a GPS bracelet. He must register as a sex offender, and may not have any contact with children under the age of 16. He may not use drugs or alcohol, and is subject to random screens. In addition, he is to have no contact with and must stay away from the victim and any witnesses in this case, effective immediately.
